"The SDA HOUSING Podcast" is brought to you by the team at NDIS PROPERTY AUSTRALIA. Whether you are listening as an Investor, Provider, Builder, Developer or Participant, we cover a wide range of topics informative to any audience. - 233 - EPISODE 234 - SDA MASTERCLASS: MelbourneMinh and Debbie discuss their recent trip to Melbourne, where NDIS Property Australia's first ever SDA Masterclass was held.
They review the various meetings they held with investors, brokers, developers and other consultants (both in the masterclass and days prior to the event) and they discussed in detail why their first SDA Masterclass was held in Melbourne, and what the focus was. They talk about how the advanced technical content and detailed presentations provided by the speakers differed from past events and workshops. This was definitely not a SDA 101 event, and the attendees definitely enjoyed the content.

SDA Options for SMSF

The financial aspects of SDA purchases through SMSF are detailed, including deposit requirements (25-35%) and additional costs (around 20%). In this episode Minh & Debbie chat about our highly requested ‘fee-for-service’ offerings, from reports (data, financial feasibility and more) to consultancy and project management services we offer at an hourly rate or fixed fee retainer. Investors should be given the choice as to how their advisor is being remunerated. Judging from the outcry and backlash of our last episiode (#231), where builders and marketers are rising up in protest against what was said, we say to those who are whispering behind closed doors:
"Y’all must have done some pretty dodgy shit to be ringing around to complain to each other about our last poddy & saying that it should to be taken down. Requests to delete = denied!" LOL. Just keep protesting because we hear everything said, and the continued misconduct will result in more evidence being collected next to names in a little black book 😂
Moving on, though, we feel that the SDA investment sector needs to shift away from "undisclosed commissions" and give more transparency to investors for obvious reasons, not the least being that investors find it very difficult to get the honest and accurate advice. Consumers need correct reporting to make independent investment decisions.
About 15 years ago, we saw the financial services industry move away from a commission-based sector into a fee-for-service system, and we also believe this is the way the SDA investment and advisory sector should head too. Who knows if it will ever happen, maybe 10 years from now, but at least the idea is out there now, for investors to choose how their advisor should be paid.

Well here it is folks! The big reveal, the big topic ... the SDA WALL OF SHAME! Minh has dropped the hint a few times now that this episode was coming, and today we invite back Brad Fuller from Brighter Living, to come into our Brisbane office, to contribute to this controversial episode.
To begin with, lets be clear that we we wont be 'defaming’ anyone in this episode as that would make us the bad guys, but boy oh boy do we wish we could spill the beans on all the dirt on the "who" and the "what" we know of in the SDA industry. If anyone from ASIC or the NDIA is reading this, please give us a call, as we have already agreed to sit down with the authorities to be the 'whistle blowers' 🥳
But that aside, lets just say that gossip and truth gets around a lot out there in the NDIS industry and lots of people talk. Whats the old saying … "Where there is smoke, there is fire" right? Well because of the reputations of our speakers across SDA, both Minh and Brad have had much interactions across the country with many NDIS stakeholders. The information gleaned from investors and providers has enabled our team to collate a list of organisations and individuals who are either corrupt, dirty, or "professional" bad guys who rip off investors out of their life savings, and are destroying families. ☹️
It's probably an open secret that there are lots of bad actors in the NDIS, but more so within SDA which is 100% property, and thus, there will always be "potential" conflicts of interest constantly. As such, we have this one hour podcast discussion about the types of shameful actions of agents, brokers, developers, builders, providers, or random spruikers, who come into the SDA to derive enormous profits without the care in the world about the negative impact of their actions - on investors, or on the NDIS. Making false promises, charging exorbitant fees, and leaving investors 'high and dry' without the hope of tenants in these SDA homes.
Alas, we must be careful about what we write in this episode description, as we may be held accountable. But we do encourage you to listen to Minh and Brad's thoughts on this subject matter. We caution all investors to "be very very very careful" about taking advice from inexperienced and unprofessional players in this sector. These "so called experts" can be seen "on every street corner" and when we say street corner, we mean 'everywhere on Facebook'. 🤪
We sincerely hope that the NDIA or ASIC catches up with these groups and individuals we refer to. They are blatantly ripping off investors, and hopefully they are either fined, imprisoned or banned from doing business ever again. Sadly though, white collar crimes are rarely punishable with imprisonment.
Most, if not “all” SDA spruikers are unlicensed - they are unlicensed in real estate advice, & they are unlicensed in financial advice, & they are unlicensed in disability advice. And if no licensing in any form, their Professional Indemnity Insurance will not cover them (or YOU!) for any financial losses. It will be legal damages against them personally in court, so make sure they have a nice house! :)
Investors should seek legal advice if they feel that they have been taken advantage of by fake and unlicensed businesses whom made guarantees, false advertising, lied or not disclosed conflicts to induce buyers into an SDA, thus causing financial loss.

As the Greater Bendigo Residential Strategy moves forward, the City of Greater Bendigo is focused on planning goals to create an inclusive, safe and ecological city.
The growth expected by 2036 is approximately 26% of the estimated 2023 population, and whilst not as high, the expected population growth of the NDIS population is around 11% by 2032.
Add to this the undersupply of quality New-Build SDA and the fact that 1 in 3 SDA-funded participants are not currently living in SDA leads us to see Bendigo as a high-demand location.

In this episode, Minh sits down with Ian to discuss the typical fees that are possibly being charged for SDA investment advice. This can take the form of either a Fee to Engage, a Fee for Services or Report Fees. They go through in detail about their thoughts on such costs being charged to investors, and whether its fair value.
Firstly, the guys talk about the 'Engagement Fees' concept floating around out there. This is where a company or consultant charges an upfront engagement fee before providing any advice and recommendations. This can vary quite significantly from a amounts of $3,000 to $5,000, and even upwards to $70,000 or more.
Minh & Ian discusses what is (or isn't) offered for such upfront fees, and what should be the tangible benefit to the investor. Too many SDA market players charge such fees, and offer nothing in return (rip off, one wonders???)
They then talk about the Fee for Services offering which is a more understood concept in the market, being the fees charged on a monthly retainer, or on an hourly rate, such as an accountant or lawyer would charge as a comparison.
The third type of fees are those for reports to give the buyer more data to determine whether they wish to proceed down the track of an NDIS Property investment. This is know as 'Report Fees' and this is what we commonly do provide for clients who wish to get a report from out team.
In summary, the point of this episode, is to notify our listeners to be vigilant of the fees being charged by "agents" (aka Fake Experts) - question everything! What is the service for which the payment is being made for, and what is the cooling off period, or refund policy. Don't be fooled, we say, and get everything in writing. We want investors to be mindful of what advice is being provided.

DIFFERENT TYPES OF PROFESSIONAL FEES
"Fee for service" refers to a payment model where clients pay a set fee for each service or consultation provided by a professional, such as a lawyer, accountant, or financial advisor. This differs from other payment models, like hourly rates or retainer fees, where the cost may vary based on the time spent or ongoing relationship.
An “Engagement Fee” is an upfront payment made by a client to secure the services of a professional advisor or consultant. It's typically a portion of the total fee for the services rendered and is often paid at the beginning of the engagement. This fee helps ensure the commitment of both parties to the project or consultation and may cover initial costs or preparations by the advisor.
A “Retainer Fee” is a regular, recurring payment made by a client to retain the services of a professional, such as a lawyer, consultant, or freelancer, for a specific period. The client pays the retainer fee upfront to secure the availability of the professional's services as needed throughout the agreed-upon period. The professional then typically sets aside a certain amount of time or resources each month to attend to the client's needs, whether they require ongoing support, periodic consultations, or access to expertise on an as-needed basis.

In this episode, Matt and Minh sit down to talk about one of Matt's recent prospective clients who was in such a rush to buying an SDA, madly trying to buy something before the end of financial year (btw we only in Feb, at time of recording) that he didnt even want to worry about doing his Due Diligence, and was only driven by yield. Friendly reminder everyone ... "TAKE YOUR TIME!"
While its great to jump into SDA with passion and eagerness, its also wise to take things one step at a time, and to do ones research. We have too often seen (time and time again) many silly mistakes taken by investors, by rushing in head first, and not taking into considerations the potential financial mess they will cause themselves. In contrast, Matt also speaks about the opposite extreme, of going very very slowly and being unable to make a decision, and how this also affects the buyer experience due to lack of confidence, or some other issue. This podcast is only about going at a steady pace in order to acquire the investment you are seeking, as you only get one chance to make it right. Once you execute, there is no going back, and you better hope that the decision you made was appropriate at the time.

This episode has Heather sitting down with Ian (our new SDA consultant) to welcome him to our poddy, and to hear more about his journey to Australia, then to the SDA space, and then to us as a new organisation to be a part of. Having worked in the SDA space the past few 2 years, he came across our podcast channel (as a competitor organisation) and was thrilled with the content that we offered, as this was a way for Ian to also increase his NDIS and SDA knowledge, and apply it in his role with the company he worked for. Unbeknown to him, through fate and luck, he somehow got referred to NDIS PROPERTY AUSTRALIA to join, and thus we have him as a part of our consultancy team, to help investors get a better grip on the complex nature that is SDA.
Heather & Ian talk alot about the company culture and what binds us together as a cohesive unit. In this most recent update to the data, current as at ending Dec 2023 and released mid-Feb 2024, we saw a significant change to some of the information reported on by the NDIA. That change was in the reporting of the numbers of SDA-funded participants. Whilst we lost one level of reporting, the update seems to be a significant improvement overall in demand data.
Each quarter, the NDIA release their updated SDA Enrolled Dwellings and NDIS demand data spreadsheet which is the comprehensive SDA supply and demand information the industry refers to for information on the numbers and locations of SDA dwellings, both enrolled and in the pipeline as well as on SDA funded participants.
As recommended in both the June 2023 SDA Price Review, and the December NDIS review, enhanced and more transparent data is slowly being rolled out as the NDIA's internal processes are streamlined and improved upon.
Lenore and Debbie discuss what these changes are, why they were made and the impact on the information this report now provides. The quarterly data reports can be downloaded under SDA Enrolled dwellings and NDIS demand data section on:

In this monthly episode of SDA UNLOCKED, Lorraine (originally from Adelaide) joins Debbie to discuss the supply and demand in the area of Riverland, which is the regional area of SA, close to the corner where 3 borders converge - SA, NSW, & VIC.
The Riverland is home to around 35,000 people who make their living in the five main towns of Barmera, Berri, Loxton, Renmark, and Waikerie. The climate is Mediterranean, with warm and dry summers and reasonably mild winters. The region is Australia's most extensive grape-producing area, and has also been referred to as the fruit bowl of Australia, being a major producer also of almonds, stone fruit, citrus, and olives.
There is also a large demand and virtually no supply of Specialist Disability Accommodation.
In this episode, Lorraine joins Debbie to discuss the supply and demand in the area, particularly with reference to a SIL provider NDIS Property Australia is working closely with to develop SDA properties in these regional towns.
If you are looking for a participant-led SDA investment option with about as high a chance of full tenancy as you'll get anywhere in Australia, you can't look past Berri, Loxton, Renmark and across the border in Victoria - Mildura - for prime House & Land packages for SDA.

In this episode, Heather talks to one of our staff, Lorraine, to find out about her journey into real estate, that eventually lead her into SDA. Lorraine recently came from another real estate business where she worked for 2 years, initially working as the Office Manager, but as her interest was sparked in the sales side, she progressed into selling SDA packages around Brisbane.
Lorraine explains that in her due diligence before joining NDIS Property Australia, she found such a wealth of information via our SDA Housing Podcast and was impressed with our wide variety of different types of stock, not just H&L packages, but apartments and villas located all over Australia. And that was the reason why she joined our company.
Coming from Adelaide, Lorraine is also very interested in the SDA market in South Australia. Heather discusses with Lorraine how her media and hospitality background and previous Real Estate experience impacted her decision to move into SDA property sales and how she feels the SDA investment opportunity is such a great social impact investment, with the bonus of the potential high yields and income.
Lorraine also talks about some of the stories she's heard from participants whose lives have been impacted significantly by moving into SDA.
Lorraine has always had a genuine desire to help people and make a positive impact along the way - and as William James (considered the Father of American psychology) once said "Act as if what you do makes a difference. It does".

It wasnt just SDA, that we were talking about, as its also important to understand and talk openly about housing for SDA, MTA, STA, SIL, and ILO. We've seen a massive disconnect with SDA properties particularly, sitting vacant across many parts of Australia, while many participants struggle to find appropriate homes.
In what we hope is the first of many such events, these networking events are an attempt to bridge the gap between the two sides that otherwise would rarely connect - another vitally important collaboration between stakeholders in developing SDA homes that are designed and built specifically for participants in the areas they are needed.

In this short episode, Heather introduces our newest team member Maddie. Maddie is now onboard as a Respite Coordinator, and explains her background and journey into the disability world, caring for a loved one before moving into NDIS Support Coordination.
Heather and Maddie discuss our burgeoning Respite service and how Respite/Short-Term Accommodation can support a participant's Choice and Control and the difference it makes to a participant's life as well as their family and carers. Maddie's background in Support Coordination gives her an amazing insight into the participant's lives and how Respite can be a life-changing experience.
Debbie too is also very happy to have Maddie on board to help handle all the Respite enquiries coming into our office all the time. We are also excited about our 'Dynamic Duo' - Maddie working alongside Debbie - as we roll out a nation wide Respite Accommodation Service, to cater for all stakeholders - Participants, Suppport Coodinators, SILs, AirBnB owners.
Aswell, for the benefit of potential new property investors looking for an alternative housing product in the NDIS, we are designing a "MTA-STA-AIRBNB designed H&L Package" at affordable prices ($650-850K) with potential yields of 7-10%pa gross incomes. This will give a different disability housing product across the NDIS landscape for investors to consider, which we are working very closely with other builders to "surprise the market" with. Following on from Episode 210, Paul Grant from Axis Lending returns, where previously discussed was all things NDIS finance , Paul once again sits down with Minh in our Brisbane office to talk about the process of obtaining finance for an NDIS investment property if planning on using one's SMSF (Self Managed Super Fund).
SDA Property offers a great investment option for people approaching retirement who are wanting to avoid investments such as the stock market, or underperforming retail and industry funds.Self Managed Super Fund and NDIS property investment rules permit Australians to invest in NDIS property as part of a diversified asset allocation strategy.Using SMSF to buy SDA property is a ideal way to invest in residential property achieving very high rental yields with an ethical investment.
Building a property within your SMSF is a far more complex process as, by law, an SMSF cannot take on a construction contract and 2-part H&L contract. Minh and Paul go through the step by step process in setting up and implementing compliant strategy which is approved as per the SIS Act, issued by the ATO.
Paul explains the process to get around this legality and the additional costs involved, when engaging a third party service that will 'wrap up' a two part contract H&L package, for NDIS, into a one part contract 'completed' SDA home.
Such "Bridging Costs" for the SMSF would cover:
- deposit
- application fee (to third party)
- legal fees 1
- legal fees 2
- legal fees 3
- land tax
- valuation fees
- finance application fees
- 12 months interest payments in advance
- stamp duty 1
- stamp duty 2
- lenders mortgage insurance (LMI)
- other purchase costs
- other finance costs
- valuation shortfall (if applicable)
Beforehand, an investor needs to do the following before beginning an SMSF for SDA:
- seek independent financial advice (financial planner)
- setup SMSF (accountant)
- setup BARE TRUST (accountant)
- seek legal advice (solicitor)
- sell down funds from current super
- rollover funds into cash bank account
- engage a third party to convert a 2 part contract, into a 1 part contract (if applicable)
- seek finance pre-approval (NDIS lender)

Dan & Jessica Acfield from Everhomes - a QLD SDA Provider - join Debbie and discuss all things funding - from the complexities of having participants with different funding levels to the level the house is enrolled as, to the challenges in getting the SDA payments from the NDIA.
Dan explains the process of how a participant gets SDA funding in their plan from application, preapproval and approval to moving into an enrolled SDA home to enable their funding to be paid to the property owner. Jess then clarifies how a participant can use their funding flexibly to reside in a dwelling type that may not be the same as what is in their plan. They discuss how a participant with funding for one category can live in a dwelling certified and enrolled as another type and how that might work along with the process and time frame to change the funding a participant has in their plan.

Today we welcome Luke Kelleher. He has been working in the SDA space as a Building Designer for about 18 months, and we thought it would be great to get him onto the show so our listeners can hear the ins and outs of working with builders and investors when it comes to SDA housing.
You must be asking, "Isn't the role of a Building Designer in SDA pretty straight forward?" Well, yes and no, as they do play a crucial for ensuring compliance and successful project delivery from concept design to completion. Here’s a breakdown of a Building Designer's responsibilities:
1. Understanding the SDA Design Standard: The Building Designer must have a thorough understanding of the NDIS build design guidelines related to SDA to ensure that the design meets the required standards for accessibility, safety, and functionality.
2. Concept Design: The Building Designer collaborates with stakeholders, including developers, architects, engineers, and disability support providers, to develop the concept design for the NDIS development. This involves translating the project requirements and objectives into a preliminary design concept that addresses the specific needs of people with disabilities.
3. Compliance Review: Throughout the design process, the Building Designer conducts regular reviews to ensure that the design complies with all relevant building codes, accessibility standards, and NDIS guidelines. Flying all the way from Perth to Brisbane for a 3 hour meeting, we have Paul Grant from Axis Lending. He must not have heard of Zoom! Just kidding, what a wonderful gesture, thank you Paul!!!
Paul sits down with Minh in the office to discuss the process of obtaining finance for an NDIS investment property, and whats needed to understand from an investor's perspective. He explains why the main banks and lenders are not currently lending for SDA and everything the investor should be aware of from fees to valuations and time frames involved in the entire process, from pre qualification, or borrowing capacity determination to final approval.
As finance is the most important part of the purchase process, we cannot emphasize enough the importance of getting this critical stage sorted out, before you even go shopping for a SDA property. This process normally take 1-3 weeks, for BORROWING CAPACITY, then preparation of docs and assessment, to achieve PRE-APPROVAL. Then the VALUATION process is 5 or so weeks, then the FORMAL APPROVAL is being worked on, and then another 2-3 weeks to arrange for SETTLEMENT (assuming blocks are titled and ready). Overall, the total process should be about 10 weeks, and most likely 12 weeks if waiting on EQUITY RELEASE from the current home loan lender.
Thus the reason why "FINANCE" is the most important step in your journey of SDA acquisition, because there is so many moving parts to achieve the ultimate goal, which is FORMAL APPROVAL.

On this monthly episode of SDA Unlocked, Debbie takes a look at the SDA data for the Hunter Valley in NSW, specifically the Cessnock and Maitland areas. By delving into the current supply and demand, Debbie gives an overview of what the current supply is made up of, and the potentially significant undersupply of 'New Build' SDA in the region, data that is backed up by on-the-ground intel provided by SIL providers who work in the area.
This episode came about because of an invitation to NSW by a SIL Provider who wanted us to help them with their business growth, by showing us on this region of the Newcastle & Hunter Valley, specifically the Cessnock & Maitland & Rutherford suburbs. Minh visited some SDA homes in these areas, and assessed the demand (and lack of supply) of enrolled dwellings aswell. His next step, after staying the day, was to go further down to Sydney to visit this SIL Provider's office to better understand their operation and presence in this Hunter region, and how they were growing their presence and workforce to meet the demand. Following on from this trip, our office invited this SIL Provider to our Brisbane office, to better educate the SDA people in our office, more about the SIL side of things when it comes to care provision to Participants.
These are the things we do, to ensure that our "grass roots level research" is accurate and on par with what our listeners, the investors, expect of us, as an advisory business.

Ben talks about their company's humble beginnings 3 years ago, and how they have turned away so much business because the investors requirements do not align with their business values, in this SDA space. He talks about their special relationships with certain Providers on the ground, who come to their brand to build their own homes that they as Providers also want built within their portfolio. Ben talks about their target of infill areas around South East QLD, and how they will be working towards double storey SDA homes aswell into the future. It is very clear from the interview that their company will not build SDAs in the outer masterplanned communities away from infrastructure and amenities, and that they are very much outcome focused when it comes to the end product for SDA Participants.

We have another special visitor (third time) of Brad Fuller to our office. We welcome him once again as he imparts some wisdom and knowledge to our listeners on the topic of 'how and when to engage SDA Providers for SDA Apartments'.
Over the years, there has been so much emphasis on houses in the SDA market, that we often forget about the other types of properties being developed and built for SDA Participants. Remember, Participants reserve the right to 'Choice and Control' on where & how they live their lives, and also who they live with. Considering that 50% of all SDAs being built across Australia are in fact apartments, perhaps it is time for us to give recognition to this new asset class within the NDIS, the SDA Apartment.
Looking back 20 years or so, recall how Australians began to embrace the strata living lifestyle of apartments as the new trend. Perhaps we should also be open minded to this emerging trend where people with disabilities are also keen on living vertically in 'brand new' low, medium & high rise apartments. Why? Well it's pretty obvious isn't it - the offer of security, privacy and desirability - factors which may not be available whilst living in a group home with other participants.
You will know by now, over the past 2 years and 200 episodes that we often talk about "apartments"; we don't discriminate when it comes to any SDA - houses, villas or units. So here today, we open the discussion with Brad who also has had many years of experience in the traditional apartment market, who also shares our values and beliefs in the future of SDA leaning towards apartments aswell.
More importantly however, it's time to talk about how investors are able invest in SDA can provide a home for Participants, by working closely with SIL & SDA Providers that are also aligned to the SDA apartment model. Thus is the purpose of our episode - to bring awareness to Participants, Providers, & Investors - of apartments being a viable investment option within the SDA market.

This episode is an 'Investment Strategy' podcast for one of our avid listeners. Debbie and Minh sit down together to do their best to give some general advice (wink wink) to help a person who thinks he is not in a position to look at SDA right currently. But in this episode, the team shows that there is "more than one way to skin a cat" as the old saying goes. Minh talks about using 'timeframe build delays' for this potential investor's advantage as he awaits the sale of his home in about 15-18 months time aswell as using the liquid funds available to use as a 10% deposit for a house (one part) or apartment or villa, which falls within his timeframe of entering the market later.
Also, a great deal of the discussion centres around initiating an SMSF entity, to beef up the client's superannuation funds in preparation for retirement. Superannuation is the most tax effective way to build the clients long term wealth and draw down an income stream in an effective manner long term in retirement. Why, one may ask? Because income tax is only 15% in super, and 10% capital gains tax in super. But if an asset is disposed of after 12 months of ownership, CGT falls by 50% (aka 5%), but then it also drops to 0% if disposed of at retirement age.
Because of this investor's stage in life (58 years of age), this "general advice" provided is very much centred around the use of the superannuation environment as a vehicle to build his retirement portfolio with SDA properties in a tax effective manner.

Today we have Brad Fuller, one of our SDA friends who has been working as an SDA Provider for the past 4 years. Being based on the Gold Coast, near us in Brisbane, we have become good business acquaintances over the past few years, because our business ethics and philosophies within the SDA space are very much aligned.
Minh invites Brad onto the show, first and foremost, to introduce him to our listeners and allow Brad an opportunity to share his thoughts on NDIS 2.0, more so in relation to IL and the Robust topics.
But more importantly, this episode corrects Minh's mistaken opinion on the concept dual key robust design, to be used as IL, and later on ROBUST, if IL is phased out. Minh had previously discussed with Debbie about the dual key robust design as a possible fall back position, but now have realised, after chatting to Brad, that Bruce Bromley was correct in his comments about it not being a good idea.
“MY BAD!" says Minh, and he is owning up to his error of the floor plan concept raised as an idea for episodes 194 & 196.
Brad talks about the topic of 'Restrictive Practices' caveat imposed by the Commission, and reinforces on the brief comments by Bruce Bromley (from which Episode 196 was based) ended up being correct. Brad agrees with Bruce in that it doesn't allow for this house design to be future proofed in the way that Minh spoke about in the earlier episodes. By bringing on Brad to discuss this matter, we have cleared up this error on Minh's part, and now give more clarity on options for investors. Hence, they conclude that it's probably best to not build an IL in 2024, but instead build a normal ROBUST house instead (for IL purposes).

Anyway, this discussion between Brad and Minh becomes an open conversation about alternatives to just building an IL house in this current climate of uncertainty, and Brad explains to our listeners (after chatting to Minh in great detail behind the scenes) the paths moving forwards for investors already locked in and committed to the land purchase which was originally intended for IL.
In summary, the options for incoming IL investors are as follows:
1. If your block is big enough, upgrade the build design to be HPS (assuming cost is okay)
2. If your block is not big enough (ie wider frontage) consider a ROBUST design, assuming the block of land is situated in an ideal position away from nearby houses, and close to hospitals with disability services
3. If your block is not suitable to robust, your choice is to continue with the build as an IL and pray that there is little impact on future changes to the IL category int the short term.
4. If options 1, 2, & 3 above are not an option, then try and 'sell the block' back onto the open market if you don't feel comfortable with the SDA market conditions, and restart again with a build in a different location.
5. Follow through with the IL build, get your IL incomes over the next few years, and reassess in 2028/29 if the option is to sell if off, or rent it back to the normal residential market tenants, post returns received circa $750,000 after 5 years (before costs)
We think this idea of building Robust instead of Improved Liveability is the best path moving forwards to future proof the investment property in SDA, if HPS is not viable.

This is an episode about the Disability Royal Commission, in particular the stories of Participants that came out a few months ago from the findings of the DRC.
Upon the release of the DRC, we were able to order the hard copy books provided, and had them delivered to our office. Within the 20kg of books delivered to our office, were 3 specific large books which had up to 9,000 stories of Participants telling us of the abuse they had to endure as a disabled individuals while under the protection of the NDIS.
We felt it was important to share some of these stories to our podcast listeners, to show the massive undertaking that brought out the truth of what took place in terms of abuse, over the last decade or so. This is part of our history, and these stories should be heard. We now give a platform for some of these stories to be read out, by Dhanika from our office, to give these victims a voice for us to hear, and to never forget what happened.
If you get a chance, please google the 'Disability Royal Commission' and look for the section on their website which allows you to order these books for free. The DRC is a moment in our Australian history, and these abuses took place under the supervision of all sorts of stakeholders who were supposed to protect these vulnerable people. We can only feel sorry for what took place all these years ago, and if there is one thing we can do, then it is to listen to this episode - their stories must be heard.

There was a question submitted by one of our regular listeners after #194, by Bruce Bromley, from SDA CONSULTING GROUP, whose business has been featured 3 times on our show now. Minh gives a detailed response to Bruce's question about the implications of volatile behaviours in the previously mentioned a 'dual key' robust house design. However, it was emphasised by Minh that this concept design discussed in episode 194, albeit being a "ROBUST", was simply just one idea as a 'temporary solution' by treating it as an "IMPROVED LIVEABILITY" house first and foremost. It's more about how investors' could or should hedge their bets with a fall back position should the worst happen (i.e the killing off IL as an SDA category) at this milestone which is the NDIS reboot.
Why a temporary solution, you may ask? Well, that's because the question at hand, both in episode 194 (and this #196) is "what will happen to IL?" As discussed, if IL is going to be gone from the equation, one of the best paths forward (maybe??) is to build an Robust dual key hybrid designed house, to be used primarily as a IL enrolled house (2 IL participants + OOA), or an IL enrolled dual key house with 2 IL participants + 2 OOA, or an ROB enrolled dual key house with 2 robust participants + 2 OOA, or a ROB enrolled house with 1 participant & 1 OOA, or ROB enrolled house with 1 participant + 2 OOA, or even ROB enrolled house with 1 participant + 3 OOA. The possibilities are 'almost' endless, if the concept design is future proofed, even to the extent of making it an SIL house, and not SDA.
The idea of this concept design mentioned was the 'what if' solution, just in case IL is 100% eliminated from SDA, once the 5 year transition has completed. Because without a temporary solution, we will see many investors sit on the fence and remain non-committal to SDA, thus creating uncertainty for investors.
This will obviously create an imbalance in SDA housing supply and demand for the next few years within NDIS over the next 3-4 years (we think). We are already in a precarious housing supply situation at the moment across Australia, even more so for many of the NDIS participants, both SDA and non SDA, are now finding it more difficult to source appropriate disability housing solutions which are 'fit for purpose' in the locality they want.
We fear that until the NDIA gives more clarity on what its IL stance is, or more so, what the new SIL housing category is (aka combo hybrid of legacy housing, basic, and improved liveability) many investors, developers and participants will hesitate in 'coming out of the woods' so to speak, and remain hidden away from sight, until further clarity is provided on the future of IL within SDA.

In this episode, Minh & Debbie discuss their thoughts (aka OPINIONS ONLY) about the implications on the changes to Improved Livability SDA design category following the recommendations from the recent NDIS Review. Given the concerned feedback from many providers, investors & developers on social media about the repercussions of a proposed change, this episode truly will be an important milestone in the evolution of SDA for years to come. They discuss the likelihood of the changes taking place, alternative options for investors to consider, and potential time frames for the implementation of any changes.
For many investors who are already holding IL property within SDA, we 'think' they should be fine, and we don't see much of a change. For those that are already under construction, and will be seeking IL participants in the coming years (before the changes take place) we have our fingers crossed that they should slip over the qualification line. However, as to future IL property (way down the line) and future IL participants which are not approved before the recommended changes, we are a little unsure of what the outcome will be.
This episode really is about the pros and cons, of the actions recommended for IL, and whether grandfathering rules are implemented. For now, it's a "wait and see" approach that developers and investors and potential SDA participants for IL funding, need to undertake. Again, we reiterate, its "OUR OPINIONS ONLY" on this important matter before us, and it will interesting to see how the NDIS & Minister Bill Shorten executes the changes to IL in the coming year(s).

Minh and Debbie sit down to discuss and answer an email received from a Provider wishing to move into the SDA space. This newly registered Provider is looking to do both SIL and SDA, having both registrations approved by the Commission. This Provider wants to consider the benefits of moving over to Sydney from Perth (currently based), to perhaps start up a new business doing SDA primarily. He wanted to know what the best strategy is, to either source participants first or to source builders first. Debbie and Minh talk about the challenges in wearing both hats etc, and if feasible to do so either in Sydney versus Perth. There is always challenges in every startup business, and an NDIS Provider business is no different. They try to do their best given the email questions received from this Provider, and try to give some realistic answers in light of the 'request for help' in getting some direction as a start up SDA Provider.

Debbie & Lenore from our research team analyse the findings of the Housing Hub in their latest report - the SDA Supply in Australia. The report delves into the findings from a nationwide survey among SDA providers carried out by Housing Hub and Summer Foundation in September 2023 to determine where and what SDA is in the pipeline from providers around Australia. The report also covers elements of provider sentiment in the SDA market in general. Recent demand projections estimate that by 2042 over 36,000 people with extreme functional impairment and/or very high support needs will require SDA housing.
This report presents an overview of the future SDA supply in Australia. Building on previous Specialist Disability Accommodation – Supply in Australia reports, the Housing Hub conducted a nationwide survey among SDA providers in September 2023. The aim was to gather information on SDA currently being developed, offering clarity for the broader SDA community and the NDIA .

There seems to be a lack of "property management" experience in the SDA Provider space across this industry, and we thought it be worth the effort to delve in greater detail about the subtle differences when comparing with other SDA Providers. The process of enrolling a property as an SDA dwelling is discussed along with how Participants are sourced. The intricacies of the different types of dwellings, locations and participant funding are highlighted as reasons why it may take longer to tenant some properties.
The ladies also discuss what they offer to the industry as licenced property managers in addition to SDA providers and how many different stakeholders are involved behind the scenes when it comes to looking after properties, ensuring it's set up ready for the tenants and that all the paperwork has been looked after and is in place. In this episode, Minh interviews Peter Ingram, a Business Consultant who specialises in NDIS property. He provides B2B services to builders and real estate agents around Australia. They discuss Peter's background as a tradie who moved into project management and life coaching before becoming a property investor himself who moved into helping others invest in property.
Peter moved into the SDA space around 4 years ago after an SDA Provider approached him because of his track record in building investment properties. Once he understood the reality of the SDA space and why the government pays such high rents to house people with disability in specialised housing, he saw it as an obvious progression for his business as an investment option.
Peter explains why SDA builds cost more and the initial difficulties in getting finance as well as the complexities of understanding how everything works. They discuss the mistakes people make when embarking on an SDA Property investment as well as the optimum design type, build size and locations when looking at the returns now being offered from the updated price guide.
Lastly, Peter reiterates the importance of looking into financial capacity and buying entity up front and speaking to the right people to get advice on the entire process and what sort of SDA property will suit your investment requirements and capabilities.

In this episode, we have 2 very special guests, Cheryl & Chris Joseph, the owners of a small business which started 3 years ago and has grown very fast since. The business is called ASPIRE HUB, and are based in Brisbane, but now also expanded to Perth. Minh asks both of them about their SIL business, and their housing model, given the changes of the NDIS over the last few years.
Cheryl talks about how different it is in running your own business, when compared to working for someone else, being an employee. Chris talks about the compliance within the business, to ensure the values and operation aligns with the NDIS, aswell as managing their staff and retaining good staff, to deliver the best service for participants. Aspire Hub specialises in SIL homes and ILO, not in home supports that many other care businesses to operate in. She explains the differences between the different care business models in the market place.
Minh also asks Cheryl how different it is operating in Perth on the west coast, as compared to Brisbane on the east coast. It is interesting to hear what Cheryl says about the challenge it is to work with people in Perth, who are all new to the NDIS.

This is the second instalment on our views on the Disability Royal Commission publication. Recently, in the first instalment, we had Dhanika and Brendon talking about 'employment' and 'education', two minor topics from the DRC. However, in this episode, Minh and Brendon brings it all back to the fundamentals of the DRC, and that is the abuse within the NDIS of participants, particularly 'group homes'. Brendon and Minh talk about examples of cases of different types of abuses, and the rorting of NDIS funds by unscrupulous providers, operating under the radar as 'unregistered' providers. Brendon also talks about how easy it is for independent support workers to approve their own NDIS Workers Screening Test, and the impact of this loophole without proper checks etc. Some of the topics discussed just brings everything back to how flawed this insurance scheme is, and how it is hoped that many changes will occur moving forwards because of the DRC 5 year investigation.
ROYAL COMMISSION
The Royal Commission into Violence, Abuse, Neglect and Exploitation of People with Disability (DRC) has handed down its final 12 volume report with 222 recommendations. Here is one topic covered in the DRC:
Group Homes
Commissioners called on the NDIS Commission to prioritise the implementation of the Own Motion Inquiry into Aspects of Supported Accommodation – Action Plan. They also want it to include a review of mechanisms to transfer away from Supported Independent Living and Specialist Disability Accommodation (SDA) being delivered by the same provider, and actions that see disability providers implement models of practice, such as active support. They want to see an implementation plan with explicit timeframes and annual reporting on progress.The DRC offers recommendations for establishing more inclusive housing options and wants to see NDIS funding models reformed to provide greater flexibility. It calls for pricing mechanisms that do not favour group home living over other models of inclusive housing. Commissioners Bennett, Galbally, McEwin, and Mason have also called for a comprehensive roadmap to phase out group homes within the next 15 years.
Commissioner Ryan suggests an alternative approach to phasing out group homes over time, starting by not approving SDA with 4 to 6 bedrooms. Ryan suggests that new NDIS participants should only be able to enter group homes as a last resort and that priority should be given to moving existing residents out of group homes into smaller groups over time. Ryan also suggests that annual progress and outcomes should be reported to the Disability Reform Ministerial Council.

In this episode, part 1 of 2, Dhanika and Brendon discuss the Disability Royal Commission into violence, abuse, neglect, and exploitation of people with disability.
The Royal Commission recently released its findings in a series of documents with over 200 recommendations for change. With over 5,000 pages of information, we've only skimmed the surface so far but we go over some of the noteworthy points such as:
- Phasing out special schools and segregated education
Students with disability who are educated separately from other students rarely transition to a mainstream school or classroom. This can contribute to them remaining in other segregated environments throughout their lives.
- Phasing out segregated employment
Including AED's (Australian Disability Enterprises) a concerning type of workplace that potentially infringes on people's human rights, with sub-minimum wage pay.
- Phasing out group homes
Group homes are often undesirable environments where, as the inquiry was told, abuse and neglect are pervasive. Some of this change is already happening with NDIS and the new SDA builds. Four commissioners want group homes phased out entirely over the next 15 years.
Several other recommendations such as the introduction of a Disability Rights Act, are being implemented to move Australia forward in aligning with the UN Convention on the rights of persons with disabilities.

People with disabilities are being 'trafficked' for their NDIS funding.
Recently, a disconcerting and heart-wrenching revelation has come to light within the National Disability Insurance Scheme (NDIS) landscape. Reports have emerged detailing a disturbing trend wherein individuals with disabilities are becoming victims of masterminded schemes that robs them of the very support they depend on for their well-being. This exploitative phenomenon involves some NDIS providers who "overcharge & defraud the scheme" by luring vulnerable individuals into seemingly promising group homes, only to subject them to neglect, abuse, and inhumane conditions.
The NDIS, initially established to empower and support people with disabilities by providing them with tailored services and funding, is now inadvertently facilitating a distressing criminal activity that has left countless individuals in dire straits. As we delve into this issue, it becomes clear that the lack of oversight by the NDIS Quality and Safeguards Commission has allowed this exploitation to persist, putting the lives and well-being of those it is meant to protect at grave risk.
This alarming trend is as cunning as it is cruel. A very small number of NDIS providers entice people with disabilities into group homes, holding out the promise of comprehensive care and support tailored to their specific needs. These promises, however, often prove to be hollow, with individuals finding themselves trapped in nightmarish situations.
Victims report that once inside these group homes, they are subjected to grossly inadequate care, unsanitary living conditions, and, most alarmingly, physical and emotional abuse. The stark disparity between the promises made and the grim realities faced by these vulnerable individuals is a clear indication of the gravity of the situation.
One of the most haunting aspects of this issue is the sheer number of individuals who have seemingly vanished within the NDIS system. Reports suggest that hundreds of people with disabilities are unaccounted for, their whereabouts unknown. These missing persons are often those who have fallen victim to these predatory NDIS providers.

In this initial episode Debbie is joined by Karina and Nicole from SDA Consulting Australia. Karina and Nicole discuss the roles of an SDA Provider as a Disability Property Manager. Nicole is a Property manager with over 18 years experience so she looks at the process very much from the property management perspective.
They discuss the modifications and additional requirements needed by individual participants over and above the standard provisions in the property. A lot of these modifications may need to be paid for by the property owner, particularly if they wish to secure a particular participant as a tenant, however, some additions are funded by the SILs or can be funded through the participant's plan.
They discuss the fact that all SDA-funded participants have to fit into one of 4 broad SDA categories and given the vastly different needs and requirements each individual will have, it is understandable that additional modifications might be needed to ensure the home is suitable for the participant's needs.
The ladies also discuss the SDA property certification and enrollment process to ensure a property is registered with the NDIA and is ready to be tenanted by NDIS Participants as well as the sourcing of participants and the various stakeholders involved in assessing the home for suitability and any modifications required, along with participant matching for multi-tenant homes. The potential vs. actual incomes a property owner may receive are discussed regarding the funding that a participant has as opposed to the funding level that the dwelling has been enrolled for.
The challenges for everyone involved are covered from funding levels, expectations of income by owners, separation of supports and communication between the various stakeholders. Karina and Nicole finish up by explaining the amazing difference to a participant's life that moving into an SDA home can result in - which at the end of the day is the primary reason for Specialist Disability Accommodation.

In this episode, Minh and Brendon sit down and talk about an email received in our office, sent by a family in QLD who wanted to touch base with Brendon and let him know that they were inspired to hear about Brendon's battle for appropriate SDA funding after going through the AAT. This family has also been through the AAT three times over the last 2 years, and had almost given up hope, until they heard Brendon's story on our channel.
Brendon talks about how there are some law firms doing pro bono work for NDIS participants fighting the NDIS, but more importantly how hard it is to navigate the legal process of battling the NDIA for correct funding. This episode is all about revealing to our listeners the other side of NDIS - and that is, the path to 'choice and control'. It's when Participant's and the families that support them, struggle for this simple right to get 'choice and control' when it comes to accomodation, and how they live their lives struggling to achieve independence.
This Participant's story highlights the challenges many face in the NDIS in their pursuit for 1:1 and not 2:1 care. Let's take a moment to appreciate the strength and resilience of those who fight for their rights in the face of adversity.

In this episode, Josh and Minh sit down together to chat about the due diligence that is done every day in assessing SDA projects & locations etc to fulfil our preparation to present to our investors. Past podcast episodes talk so often about data research, but our team hasn't really spoken too much about 'product assessment' per se. In this episode, Josh helps our listeners better understand the mechanics behind our "DD" to workout exactly that.

Our team as a whole, are working with a developer to help bring to market 5 HPS townhouse villas, which are designed as OOA + 2 participants (3B/3B/1C). The discussion centres around what needs to be put together in the background in order to ensure that we as a team, are satisfied with the demand in any particular area. In addition, the design, the builder, and the end product which are meant for long term tenancy for SDA residents, needs to be assessed carefully too. while also giving SIL Provider (not selected yet) the opportunity to run their business in an efficient and profitable manner by having 5 dwellings side by side to manage.
This sit down chat isn't a in depth discussion about the development itself, but more so about what we as a small team of SDA professionals, need to gather and check over first. We do go off on a tangent a little about other matters (apologies) but it just shows how passionate that we are as a business, to ensure that we are always transparent and focused on delivering a positive outcome for the community.

Happy Friday everyone! In this episode, Minh, Debbie and Elizabeth, our Melbourne-based consultant, who has flown up to Brisbane for a few days to meet with various builders and stakeholders, sits with us to discuss what's happening in the SDA market in South East QLD.
A lot has changed since the new SDA prices were released in July, giving the market throughout Australia a major boost in terms of financial viability to develop better Specialist Disability Accommodation in areas that have been under-serviced or inadequately serviced.
For the last year or so, we have been talking about many parts of South East QLD being oversupplied with SDA, or at least oversupplied with certain types of SDA builds. Additionally, as the industry has matured, the right and wrong types of SDA builds and construction have really become evident. Many of the original SDA builds were built to barely meet the SDA design standards, with no consideration for building above and beyond to meet Participants' and Providers' needs and requirements. This is becoming clear when looking at tenancy levels in a lot of properties that are built to house 2 or 3 or more participants, but have just one tenant, or the data from areas that have a high percentage of Participants who are living in SDAs but are looking to move.
The discussion focuses on how the design and quality of the builds and builders' understanding of the market is paramount in developing high-quality and future-proofed SDAs that will last the test of time. Minh, Debbie and Elizabeth also talk about how it is vital to understand the entire investment opportunity from a focused research perspective and a Participant-centric angle.

Pam reached out to Brendon via her Support Coordinator, after Brendon called out to "anyone" with a NDIS journey in SDA, and he wanted to hear all stories, both good or bad. Thus we now have an episode with 2 HPS Participants chatting about SDA within the NDIS scheme.
While it is rare to hear firsthand about Participants' stories, this is one of those special moments where we as listeners will appreciate Pam's personal journey. Earlier this month the NDIA released the final element of the Specialist Disability Accommodation (SDA) Pricing Review process – the SDA Pricing Review 2022-23 Demand Projections Report. The Report provides demand projections for SDA both in terms of geographic locations and design categories. It goes through to 2042.
With this published SDA DATA, we finally have some direction of the SDA numbers and growth in each region, for which these SA4 Regions projections apply to.
Minh and Debbie really give their professional opinion on the data, as they really love talking about statistics, and forecasts. They certainly nail it on the head with all of their hard work the past 18 months on The SDA HOUSING Podcast, having given their predictions and determinations for over this time as to where investors should be focusing their efforts in getting a foot into different SDA markets across Australia. In summary, they called it correctly having called out 8 out of 10 in the top 10 regions correctly, in the top SDA growth areas to invest for the next 10 to 20 years. Woot Woot!!!

Adapt's office is situated on Eagle St, Brisbane CBD (a high-rise commercial office building) and makes it easier for us to meet up regularly to chat SDA. #thanks #adapt
Brendon is a new team member who brings his Lived Experience of being an SDA Participant onto The SDA HOUSING Podcast. We are so looking forward to the energy that he brings to our awesome team. Brendon recently started working with our company, as PARTICIPANT LEAD, and he wants to use the platform of this channel to show his passion for advocacy work in the NDIS space to help Participants achieve what he got himself, which is 'Choice and Control' as an SDA funded Participant. What he doesn't want to see, is for other Participants to go through years of pain and stress, in fighting the NDIA at the AAT, like he himself had to endure. We know his story is inspirational, maybe not to himself, but definitely to those around him who had to watch from afar.
This episode is all about Brendon, and for him to tell his story (past and present) and his thoughts about the challenges of daily living for Participants. Its important that we as outsiders hear more from the perspective of Participants, and it is our honest hope that you our listeners set aside some time to listen to this interview with Brendon, and to think of the other 18,000 odd Participants who are funded for SDA, but most of which do not have the opportunity to live in an SDA home. There are 7,000 SDA funded Participants living in an SDA home, but another 18,000 are not)
Affordable and accessible housing for people with disabilities is difficult to secure. Many Participants face obstacles to qualify for SDA housing, let alone SIL housing, and they have to go through discrimination and exclusion constantly. Therefore, we all need to play a part in society by helping those that are less fortunate than us, and to think of the "outcome" and not the "income" (as investors) in this disability world. This is what Brendon's goal is, by being an advocate for Participants who may not have a voice to be heard.
This is why Brendon has joined NDIS PROPERTY AUSTRALIA & THE SDA HOUSING PODCAST, and that is to be heard.

He discusses his journey into the accessibility and SDA sector and what his companies does do.
Bruce tells us what SDA Consulting Australia does, and discusses the training, education and information they disseminate to the industry. Bruce also tells us his views of where the SDA sector is and should be heading and talks about his advocacy of various aspects, particularly around Robust design and Fire safety.
The discussion centres around the ideal requirements for Robust design and the failings of the current design standards and new pricing review income levels to ensure suitable development of Robust properties. Bruce also tells us his thoughts on the importance of Fire Safety in building and SDA guidelines and what classification buildings might need to be to include fire sprinklers, along with any clarification on mandatory requirements in the future.

Our team recently met up in a video studio in Brisbane with Tania Gomez, from Tania Gomez Consulting (TGC) to talk about many things SDA individually and as a group, in a film setting environment. One of these video recordings was the final session with Tania, Minh, and Dan Acfield, from Everhomes. This podcast is the audio of that final film session, and is primarily about the recent changes to SDA Pricing which affects SDA Providers. Today Minh and Jess try to navigate the environment of Input Tax Credits, GST Free supplies and claiming for GST within the specific lens of investing in SDA (What are these concepts? When do they apply? When and for what can you claim?).
Input Tax Credits and GST free supplies (and what are they in an SDA property sense)Factors which have the ability to affect whether or not you would be able to claim for GST on the build of a SDA propertyOngoing taxation considerations for when the SDA is tenanted, and best practice for claiming GST in this scenarioSpecific reference to key ATO published decisions about GST in building SDA and the NDIS minister's determination about SDA services their treatment with respect to GSTThings to consider asking your financial/tax adviser/accountant about this unique topic in SDA property, to make sure they are giving you the most comprehensive tax advice possible for your individual situation
Thanks to some determinations and ATO rulings - this area has become somewhat complex. With the ATO determining that "the owner must be a registered SDA Provider", some investors have been undertaking the process to become a registered SDA Provider themselves, in order to claim back GST on constructions. This flows on to traditional SDA Providers, as they need to develop complex corporate/leasing structures to enable the Investor/Owner to claim said GST/tax credits.
We go over topics such as:For owners to obtain the benefit of the GST exemption in the context of claiming back GST on construction costs, the ATO has determined thatthe owner must be a registered GST provider.As a result, Owners have been registering to provide SDA and requiring traditional SDA Providers to enter into complex structures to enable the Owners to claim the tax credits. The SDA Price Guide has now been updated to provide a seperate base price for dwellings constructed after 1 July 2023 , where Tax Input Credits have not been collected. SDA Providers & Owners will need to consider how these additional amounts are factored into payment structures moving forwards.
Changes in SDA Pricing Determination:
Let's be honest, one slight downside is that figuring out the right SDA price for each dwelling has just become a bit trickier. Starting from July 1, 2023, SDA prices will take into account the Goods and Services Tax (GST) position of each dwelling's delivery. The idea is that if the owner of the dwelling claimed GST input tax credits for the GST paid on the purchase price or construction costs, well, that will affect the pricing. The NDIA have acknowledged they've made this part more complicated, it will be one area to watch as the changes are implemented, given the NDIA have historically found administering their funding systems and changes difficult.

Today we rehash the journey thus far which has taken almost 3 years for Brendon to come out victorious. It is an inspriring story for others to listen in on his long journey, and we can only hope that many other Participants in the NDIS do not have to go through Brendon's ordeal aswell.
The podcast discussion also covers the latest changes in SDA, according to Brendon, more so about the SDA PRICE REVIEW recently in June. Minh also asks what Brendon thinks about future challenges that Participants will have in trying to get 'choice and control' in their SDA funding requests within the NDIS, now that that it seems the NDIA is turning a corner in their resistance to approve funding for SDA, aswell as removing the delays.
As always, we are always grateful for peoples time and efforts when it comes to sharing their stories, and we hope that our listeners can also see how hard it is for Participants to get the right amount and conditions for funding in SDA. When investing in SDA, always remember that there are people on the other side of the journey, who also want to live in your home, but through no fault of their own, government red tape and bureaucracy gets in the way of a Participant's journey to their forever home, aka your home.

In this short episode, Debbie and Minh sit down to talk about the 'Density Restrictions' when it comes to developing units in particicular, in one site. There is much demand from developers and investors in building SDA dwellings in medium or high density locations, and this topic goes through the calculations in working out how and what is possible for developers to consider.
If the density restriction applies in relation to a parcel of land, the total number of eligible participants that can receive funding for specialist disability accommodation in relation to all dwellings located on the parcel of land must not exceed:
(a) if one of the dwellings on the parcel of land is enrolled to house 3 or more residents - the greater of the following:
(i) 10 eligible participants'
(ii)10% of the total number of residents capable of residing on the parcel of land, assuming one resident per bedroom; or
(b) if all of the enrolled dwellings on the parcel of land are enrolled to house no more than 2 residents and the dwellings are part of an intentional community - the greater of the following:
(i)15 eligible participants;
(ii) 25% of the total number of residents capable of residing on the parcel of land assuming one resident per bedroom; or
(c)if all of the enrolled dwellings on the parcel of land are enrolled to house no more than 2 residents and the dwellings are nor part of an intentional community - the greater of the following:
(i)15 eligible participants;
(ii) 15% of the total number of residents capable of residing on the parcel of land, assuming one resident per bedroom.

In this episode, Jess from our office sits down with Minh again, to talk about a very 'complicated topic'. This topic is about summarising Section 13 for claiming SDA income where "the lesser of rule" is used in determining the value of the SDA income per Participant in the SDA dwelling. This is specifically known as:
Section 13 of NDIS Pricing Arrangements for Specialist Disability Accomodation 2022-23 (Released March 2023)
When claiming payment for SDA from an individual participant's plan, a provider is only able to claim the lesser of:- The maximum per participant price for which the dwelling is enrolled; The amount of SDA funding for which a participant has been assessed (i.e the amount to the SDA in their plan
This is an unknown rule which is part of the SDA PRICE GUIDE which 99% of investors are unaware of (unless disclosed by your SDA Provider) as it is rarely made aware of to investors. The SDA providers should know this, and investors 'may not know this'.
Unfortunately, investors are only told about this when they have engaged the SDA Provider. Because they normally engage the Provider once the property has been purchased (or built), this Section 13 rule is unfortunately not discussed with investors (if at all) until very far down the track. We are doing our bit in this podcast to summarise it in a nutshell, to let our listeners know about this 'grey little area'.
Let's use a practical example, to better explain to you, to better understand the numbers. If an SDA Provider enrolls a property for 2 SDA Participants only, and an investor sees that the maximum potential SDA Funding for an IL Participant is $77,000pa (SDA & RRC income), it doesn't necessarily mean that the property investor will get $154,000 (77,000 x 2). There are many other potential lower income amounts which will apply to the outcome of the investment. See below for the variations we refer to:
Example Only - IMPROVED LIVEABILITY 'potential outcomes'
IL - Apartment 2 bedroom (1 resident) ... not relevant in podcast
IL - Apartment 1 bedroom (1 resident) ... not relevant in podcast
IL - House 4 bedrooms (3 residents) - $56,000pa
IL - House 3 bedrooms (2 residents) - $77,000pa
IL - Villa 3 bedrooms (2 residents) - $43,000pa
IL - Villa 2 bedroom (1 resident) - $65,000pa
In this episode, Minh and Jess discuss the combinations of the potential IL participants, coming into a 3 bed 3 bath 2 car 'SDA house', which will have OOA + 2 IL participants. Let's say the house land package is $750,000 in cost, thus we will now work out the gross yields for each combination possible. The numbers below are being discussed in this podcast, for listeners to better understand this section 13 rule.
20%pa # - IL (1:2) + IL (1:2) = $154,000 gross income
17%pa # - IL (1:2) + IL (1:3) = $133,000 gross income
16%pa # - IL (1:2) + ILv (1:2) = $120,000 gross income
13%pa # - IL(1:3) + ILv (1:2) = $99,000 gross income
11%pa # - ILv (1:2) + ILv (1:2) = $86,000 gross income

In Part 3 of the 'Breaking News' segment this week, we have just Debbie and Minh, to sit down again (for the third consecutive day) to continue discussing some things not covered in our first two episodes on this MASSIVE news from the NDIS.
Worth mentioning aswell:- The SDA Pricing Review has estimated that the numbers to be housed by the SDA Program has increased from 28,000 to 30,000. At the same time, the annual cost of the NDIS Specialist Disability Accommodation (SDA) program will grow from the previously projected $700M to $1,800M p.a.The Review recommends a rebalancing of the pricing but no alteration to the pricing mechanism itself. Consequently, the SDA program will continue to rely on a price cap rather than a competitive market-based provision allowing developers to cherry-pick the most profitable projects. This program and pricing structure do not guarantee the delivery of all the accommodation required nor that the accommodation delivered will be well-located or contemporary, even with significant additional expenditure.
We rarely do emergency podcasts like this, 4 episodes in one week, so we hope you don't feel overwhelmed with the "SDA overdose". The new changes to the SDA PRICES are effective as of July 1 2023, but implemented from October 1 2023, and make retrospective back to July 1 from an SDA income payout.

This is the first of four instalments, with 5 of our staff sitting down to discuss the changes, and the ramifications to investors moving forwards. This episode doesn't dig too deep yet, as it's only the 'First Impressions' so far on the first day back at work since the announcement on 16th June 2023.
