Im Frühjahr 2023 veröffentlichten die Bundeszentrale für politische Bildung (BpB) und das Europäische Zentrum für Verfassungs- und Menschenrechte (ECCHR) gemeinsam eine dreisprachige Anthologie mit dem Titel “Syrische Staatsfolter vor Gericht”, die den Al-Khatib-Prozess in Koblenz aufarbeitet und reflektiert. Die Anthologie stellt den Gesamtkomplex der Staatsfolter in Syrien und ihre Auswirkungen in einen historischen, sozialen und rechtlichen Kontext.

Unser “Branch 251”-Team nahm an der Auftaktveranstaltung teil, traf einige der Gäste, darunter auch einige der Autor*innen und feierte mit dem Publikum die Veröffentlichung der dreisprachigen Anthologie.

In dieser Sonderfolge reflektieren wir das Buch ein Jahr nach seiner Veröffentlichung und sprechen ausführlich über seine Entstehung mit dem Präsidenten der BpB, Thomas Krüger, und dem Senior Legal Advisor beim ECCHR in Berlin, Patrick Kroker.

Syrische Staatsfolter vor Gericht

Einführung:

Nadine (Gast): Ich bin hier, weil ich Syrerin bin und dieses Thema für mich und die ganze Welt von zentraler Bedeutung ist. Allerdings wird es selten systematisch behandelt und öffentlich gemacht.

Hannah(eine der Autorinnen der Buches): Ich war zwei Jahre lang fast jede Woche beim Koblenzer Prozess dabei. In dem Buch wollte ich zeigen, was ich dort sah, welche Menschen ich traf und was ich über die Bedeutung dieses Prozesses lernte. Ich wollte über die Zweifel sprechen, die während des Prozesses aufkamen, über die Probleme, die auftraten. Und auch darüber, was dieser Prozess letztlich für die Beteiligten bedeutete, vor allem für die Überlebenden aus Syrien.

Fritz:Willkommen zu diesem besonderen Podcast. Ich bin Fritz Streiff, Menschenrechtsanwalt und Podcaster. Und heute bin ich euer Host für diese Bonus-Episode, in der es um etwas Spezielles geht. Nämlich um das Buch “Syrische Staatsfolter vor Gericht”: Ein dreisprachiger Sammelband, der den Prozess reflektiert,  der auch in unserem Podcast “Branch 251” im Zentrum  stand: der Al-Khatib-Prozess in Koblenz.

Wir nehmen euch mit zurück zum Abend der Veröffentlichung des Buches im Frühling 2023 in Berlin. Wir waren an dem Abend dabei und haben mit Gästen und Autoren über die Bedeutung des Sammelbandes gesprochen, und über den Prozess im Allgemeinen und was er hinterlassen hat.

Seitdem haben wir auch mit den Machern und Herausgebern des Buches gesprochen: von der Menschenrechts-NGO European Center for Constitutional and Human Rights, kurz ECCHR, und von der Bundeszentrale für politische Bildung.

Also, setzt eure Kopfhörer auf oder schaltet die Lautsprecher ein, je nachdem wie ihr zuhört, und bereitet euch auf diese kleine Zeitreise vor.

Der Start/Anfang:

Fritz: OK, wie gesagt, wir werden eine kleine Zeitreise machen, und das nicht nur zurück ins Jahr 2023 (dem Jahr der Veröffentlichung des Sammelbandes); denn um darüber zu sprechen, brauchen wir ein bisschen Kontext, und der führt uns zurück zum 23. April 2020. Der Tag, an dem die Vorsitzende Richterin des Koblenzer Gerichts den Beginn des Prozesses verkündete. Der Prozess war weltweit der erste Strafprozess überhaupt, der sich mit syrischer Staatsfolter als Verbrechen gegen die Menschlichkeit befasste. Also ein echter Meilenstein.

An diesem 23. April 2020 präsentierte die Staatsanwaltschaft ihre Vorwürfe gegen zwei Männer. 

Zunächst waren alle Augen auf Anwar Raslan gerichtet: einen ehemaligen syrischen Geheimdiensmitarbeiter. Er wurde beschuldigt, die Folter von mindestens 4.000 Menschen und 58 Morde im Al-Khatib-Gefängnis in Damaskus überwacht zu haben. Das ist das Gefängnis, das auch als “Branch 251” bekannt wurde. 

Und dann war da noch der Mitangeklagte Eyad Al-Gharib:  Seine Aufgabe war es, Demonstranten festzunehmen und sie in dasselbe Gefängnis zu bringen, in das Branch 251. Also war seine Aufgabe gewissermaßen, festgenommene Demonstranten dem Hauptangeklagten zuzuführen.

Das Verfahren hat in Deutschland nach dem sogenannten Weltrechtsprinzip stattgefunden. Dieses Prinzip ermöglicht es, schwerste Verbrechen auch in Drittstaaten, wie zum Beispiel Deutschland, gerichtlich aufzuarbeiten.

An diesem Tag im April 2020, in den Anfangsmonaten der Corona-Pandemie, war der Gerichtssaal bis auf den letzten Stuhl gefüllt. Soweit es die Umstände eben erlaubten. Es waren Überlebende da, Menschenrechtsaktivisten, Journalisten und so weiter. Das Interesse und die Spannung waren groß. 

Die Prozessbeobachter des ECCHR beschrieben den ersten Prozesstag, und vor allem das Erscheinen der Angeklagten im Gerichtssaal, damals als "aufwühlend". Es begann etwas Wichtiges, etwas Historisches. 

“Ich klage an” begann der Oberstaatsanwalt seine Anklageschrift an diesem Tag vorzulesen. Mit diesem J’accuse war also dieses weltweit erste Strafverfahren gegen syrische Regime-Mitarbeiter offiziell losgegangen…

Fritz:Beide ehemaligen syrischen Staatsdiener wurden im gleichen Prozess angeklagt, aber im Laufe der Zeit entschied das Gericht, die beiden Fälle aufgrund der Art und Schwere der vorgeworfenen Verbrechen zu trennen.

Das heißt, dass am 24. Februar 2021, also etwas weniger als ein Jahr nach Prozessbeginn, der Fall von Eyad Al Gharib schon abgeschlossen wurde. Für seine Rolle wurde er wegen Beihilfe zu mindestens 30 Fällen von Verbrechen gegen die Menschlichkeit für schuldig befunden und zu viereinhalb Jahren Gefängnis verurteilt.

Elf Monate später, am 13 Januar 2022 wurde der Fall des höherrangigen Anwar Raslan abgeschlossen. Als ehemaliger Leiter der Ermittlungsabteilung der Haftanstalt Branch 251, wurde auch er schuldig befunden wegen Mittäterschaft an mehreren Verbrechen gegen die Menschlichkeit einschließlich Folter, 27 Morde, gefährliche Körperverletzungen und sexualisierter Gewalt. Er wurde zu lebenslanger Haft verurteilt. Mit diesem Schuldspruch, mehr als ein Jahrzehnt nach Beginn der syrischen Revolution, wurde also zum ersten Mal ein ehemals hochrangiges Mitglied der Assad-Regierung wegen Verbrechen gegen die Menschlichkeit gerichtlich verurteilt.

Meine Kollegen und ich haben damals eine ganze Podcast-Serie namens “Branch 251” gemacht. Auf Englisch und Arabisch. Die Serie auf Arabisch war uns dabei immer besonders wichtig. Wir haben versucht, dazu beizutragen, eine Lücke zu schließen, die das Gericht offengelassen hatte. Nämlich die Bereitstellung arabischer Übersetzungen der Verhandlungen, für die direkt Betroffenen und Interessierten. Außerdem wollten wir den Hörern nicht nur komplizierte Juristerei vermitteln, sondern eben auch, in beiden Sprachen, ein besseres und breiteres Verständnis des syrischen Kontextes: der syrischen Geschichte, dem Komplex der syrischen Haft- und Folteranstalten und den verschiedenen Arten von Verbrechen, die vor und nach der Revolution 2011 begangen wurden.

Wir finden, man kann mit Fug und Recht behaupten, dass das jetzt hier vom ECCHR und der Bundeszentrale veröffentlichte Buch, eine der wichtigsten Dokumentationsquellen und zukünftigen Referenzen des Prozesses ist und sein wird. Die vielschichtige Veröffentlichung ist vor allem aufgrund ihres ganzheitlichen Ansatzes besonders: Die Autoren sind nicht nur Juristen, sondern kommen auch aus künstlerischen, humanitären und aus anderen AktivistInnenkreisen. 

Dass der Sammelband so gut gelungen ist, ist keine Selbstverständlichkeit. Weil, wie verdaut man einen so historischen und komplizierten Prozess in einem Buch, das dieser ganzen Komplexität gerecht wird? Darüber haben wir mit Patrick Kroker gesprochen. Er ist Rechtsanwalt und arbeitet als Senior Legal Advisor beim ECCHR, wo er die Syrien-Arbeit leitet. Patrick ist einer der Herausgeber des Buches.

Fritz:  Patrick, bevor wir ein bisschen tiefer eintauchen, möchte ich am Anfang beginnen: Wie kam die Entscheidung zustande, diese Veröffentlichung überhaupt zu produzieren? Und warum gerade ein Sammelband? 

Patrick Kroker: Es war der erste Gerichtsfall weltweit, in dem das Thema syrischer Staatsfolter thematisiert wurde. In unserer Arbeit der Aufarbeitung der Verbrechen in Syrien, die wir mit juristischen Mitteln betreiben, sind solche Gerichtsfälle, unserer Meinung nach, ein ganz zentraler Bestandteil dieser Aufarbeitung. Dabei ist es wichtig, dass Gerichtsfälle nie die alleinige Lösung sein dürfen, denn wenn man sich nur auf den juristischen Aspekt verlässt, ist die Wirkung sehr begrenzt. Deshalb leben diese Gerichtsfälle davon, dass sie dokumentiert werden und weiterhin Einfluss auf die Arbeit in anderen Disziplinen, in der Kunst, in der Wissenschaft, in der Bildung nehmen können. Nur so kann man eine Wirkung erzielen, die über den Gerichtssaal hinausgeht. Um diesen Fall zu unterstützen, dachten wir, es wäre wichtig, ein Buch zu veröffentlichen, das verschiedene Perspektiven darauf einbezieht. Deshalb war es uns wichtig, dass wir nicht nur die rein juristischen Aspekte oder die rechtshistorischen Ereignisse darstellen. Das sind Teile des Buches, doch wir wollten das Ganze in die syrische Geschichte einordnen und syrische KünstlerInnen haben, die diesen Fall künstlerisch kontextualisieren können. Wir wollten die Wirkung, die das Verfahren schon hatte, noch verstärken, sie erweitern, sodass er eine nachhaltige Wirkung hat, die über die juristischen Konsequenzen hinausgeht.

Fritz: Und da kommt dann wohl die Bundeszentrale für Politische Bildung ins Spiel. Wie kam es zu der Zusammenarbeit und was war Euch vom ECCHR dabei besonders wichtig?

Patrick Kroker: Die Bundeszentrale für politische Bildung ist natürlich der zentrale Partner gewesen bei dieser Publikation. Es gab vorher schon Kontakte und auch gemeinsame Publikationsprojekte und das hat dann dazu geführt, dass wir, als wir dann die Details besprochen, haben eben auf eine unglaubliche Bereitschaft gestoßen sind, die Expertise, die wir als ECCHR in diesem Verfahren über viele Jahre angesammelt hatten, eben bei der Gestaltung mit aufzunehmen.

Wir wollten zum Beispiel, dass sich die Bundeszentrale für politische Bildung, und das ist eines der Dinge, die ich immer fordern werde, darauf einlässt, das Buch dreisprachig zu veröffentlichen. Wir haben gesagt, es muss auf Arabisch erscheinen. Das war uns sehr wichtig. Wir wollen diese Wirkung haben, der das Volksstrafrecht kennzeichnet, der dieses Verfahren kennzeichnet. Das geht nur, wenn die Menschen, die es in erster Linie betrifft, nämlich SyrerInnen, etwas davon haben. Sie müssen dieses Buch in ihrer Sprache lesen können. Die Bundeszentrale hat sofort gesagt, natürlich, wir machen das auf Deutsch, auch auf Arabisch, und wir haben gesagt, am besten wäre es, wenn es auch auf Englisch wäre, und sie haben dem zugestimmt. Also haben sie eine unglaubliche Bereitschaft gezeigt, das zu machen, weil sie erkannt haben, was für ein besonderes Verfahren das ist, und dass wir viel Energie und Motivation in den Prozess eingebracht haben. Und für dieses Vertrauen sind wir immer noch sehr dankbar.

Fritz: OK, und wie ging es dann weiter? Kannst Du uns erzählen, wie ihr die Autoren ausgewählt habt, also wen wolltet ihr dabei haben und warum?

Patrick Kroker: Wir wollten viele verschiedene Perspektiven auf dieses Verfahren haben. Und natürlich war die Rechtsordnung wichtig und auch die Kontextualisierung im deutschen Völkerstrafrecht. Wir hatten also einen Schwerpunkt gesetzt und dann sollte der andere sehr nah am Verfahren sein. Wir wollten, dass Leute, die eine enge Beziehung zu dem Fall hatten, zu Wort kommen und ihre Perspektive und ihre Überlegungen teilen. Das war der zweite Schwerpunkt und der dritte war, dass SyrerInnen zu Wort kommen, die das Verfahren einordnen und verarbeiten, sei es aus einem historischen, philosophischen oder künstlerischen Blickwinkel. Das war der dritte Schwerpunkt. 

Fritz: Dann muss das Ganze natürlich noch in die Tat umgesetzt werden und rüberkommen.. Das Buch ist seit gut einem Jahr verfügbar. Wie war das Feedback bisher? 

Patrick Kroker: Ja, wir haben im letzten Jahr sehr, sehr positive Rückmeldungen bekommen. Das Schöne an so einer Publikation ist, dass sie in ihrer Wirkung dauerhaft ist, weil die Leute sie immer wieder nutzen können. Wir sind natürlich auch extrem dankbar, dass die Bundeszentrale für politische Bildung sie für einen kostenlosen Download in allen drei Sprachen zur Verfügung gestellt hat. Wir haben aus allen drei Sprachgruppen sehr positive Rückmeldungen bekommen, weil es selten vorkommt, dass so ein Strafverfahren im Nachhinein in diesem Umfang reflektiert wird. Und das ist eine sehr große Bestätigung für die Wichtigkeit dieser Anstrengung. Und was auch wirklich schön war, war, dass wir die Veröffentlichung der Publikation le

في ربيع عام ٢٠٢٣، أصدرت الوكالة الفيدرالية للتربية المدنية والمركز الأوروبي للحقوق الدستورية وحقوق الإنسان كتاب ثلاثي اللغات بعنوان "محاكمة جلّادي الدولة السورية"، والذي ينظر ويلخص محاكمة "الخطيب" في كوبلنز/ المانيا. يضع الكتاب قصص التعذيب الذي مارسته الدولة السوريّة في سوريا وتأثيره في سياق تاريخي واجتماعي وقانوني

حضر فريق "بودكاست الفرع 251" حفل الإطلاق، والتقى ببعض الضيوف بما في ذلك بعض المؤلفين، واحتفل مع الجمهور بإصدار الكتاب بثلاث لغات

في هذه الحلقة الخاصة، نتأمل الكتاب بعد مرور عام على صدوره ونتحدث بالتفصيل عن إعداده مع رئيس  الوكالة الفيدرالية للتربية المدنية، توماس كروجر، وكبير المستشارين القانونيين في المركز الأوروبي للحقوق الدستورية وحقوق الإنسان في برلين، باتريك كروكر

محاكمة جلّادي الدولة السوريّة

مقدمة

نادين: اللي بتمنى أني شوفه بالكتاب هو انه التجارب الشخصية للناس تكون مدموجة بالتغطية تبع المحكمة لأنه التغطية تبع المحكمة غالبا بتكون تغطية نوعا ما تقنية أو باردة أو بعيدة عن الناس وبتحسسك أنه الشي اللي صار أو الموضوع طُرح بهي المحكمة ما بيشبهنا أو مانو موجود بالشارع بس نحن كل اليوم يعني ماشيين وفي حوالينا ناس ممكن تعرضوا لهذا النوع من الاعتقال أو هذا النوع من التعذيب

خالد بركة (احد المؤلفين): هلأ الكتاب هو كثير مبادرة كثير كثير مهمة وكثير بشكر عليها الـ "اي سي سي اتش آر" حقيقة. لأنه كل دوكيومانت هلأ عم تنعمل إذا هي دوكيومانت قضائية ولا دوكيومانت فنية ولا شعر ولا أي نوع من أنواع الـ دوكيومانت اللي عم بصير هو الحرب السردية اللي كنت عم بحكي عنها قبل شوي. بتخيل هو كثير مهم لأنه عم يعطي وجهات نظر مختلفة لناس من السلك القضائي من الوسط الفني الأدبي ومن الضحايا ومن الناشطين فهو عم بكون مختلف عن اللي نسمعه بالعادة عن المحاكم

ماريانا كركوتلي (احدى المؤلفات): أنا برأيي ما في تغطية أصلا كافية، يعني قد ما كان في تغطية لازم يكون في تغطية أكثر. الشي اللي بضيفه هاد الكتاب من وجهة نظري هو تحليل الأفراد لكيف جرت هي النوع من المحاكمات وتحليلهن للإشكاليات يلي كانت موجودة بالمحاكمة

سليم: اهلا فيكم بهالحلقة الخاصة من بودكاست "الفرع 251: جرائم سورية قيد المحاكمة"

اسمي سليم سلامه، وانا كاتب ومنتج بودكاست.. بنقدملكم هالحلقة بعنوان: "محاكمة جلّادي الدولة السوريّة"، ويلي هو ايضا عنوان الكتاب يلي تم نشره بربيع 2023، والي اجتمع بكتابته عدد كبير من المؤلفين والمؤلفات؛ سوريين وغير سوريين، ليسردوا بطريقتهم الخاصة احداث محاكمة كوبلنز التاريخية، بالاضافة لتفاصيل عن تجاربهم الشخصية

خلال هالحلقة، رح نتحاور مع طرفين من ناشري ومنتجي الكتاب، ونسمع اصوات الضيوف الي كانوا موجودين ليلة اطلاقه. بالاضافة للعودة بالزمن لابرز الاحداث الي تعلقت بالمحاكمة الي امتدت على مدار سنتين

بداية

سليم: قبل ما نرجع لل 2023، سنة اطلاق الكتاب، رح نرجع لل 2020، لانه الحديث عن  هالعمل مش ممكن يبدأ من غير ما نراجع السياق الي تم نشره من خلاله.

بيوم 23 نيسان 2020، ضربت رئيسة محكمة كوبلنز مطرقتها معلنة بدء محاكمة الخطيب، الي جرت بمدينة كوبلنز بألمانيا. هالمحاكمة اعتبرت تاريخية لأنها كانت أول محاكمة جنائية في العالم بتتناول موضوع التعذيب الي قامت فيه الدولة السورية بسوريا، ضد سوريات وسوريين.

بهداك اليوم، عرضت النيابة قضيتها ضد أنور رسلان: ضابط المخابرات السوري السابق، والي كان متهم بالإشراف على تعذيب ما لا يقل عن 4000 شخص بفرع الخطيب بدمشق، والمعروف باسم الفرع 251، وايضا ضد متهم تاني اسمه إياد الغريب: الضابط السابق الي كان بيحمل رتبة منخفضة بمديرية المخابرات العامة السورية، والي كانت وظيفته اعتقال المتظاهرين ونقلهم لنفس مركز الاعتقال: الفرع 251.

يوم المحاكمة تزامن مع الاشهر الأولى من جائحة كورونا، وبالرغم من هالظرف، امتلت مقاعد جمهور قاعة المحكمة بالضحايا وعائلاتهم واصدقائهم، نشطاء حقوق الإنسان، والصحفيين.

حسب تقرير نشره المركز الأوروبي للحقوق الدستورية وحقوق الإنسان، "كان يومها في شعور واضح عند الحضور بالأهمية التاريخية لهالمحاكمة، عدا عن كثافة المشاعر الي كانوا حاسين فيها الضحايا والشهود… كتار اعتبروا انه هالمحاكمة هي خطوة نحو تحقيق العدالة لضحايا وحشية النظام السوري".

سليم: المحاكمة بلشت بقضية وحده ضد المتهمين انور وإياد، لكن بعد وقت قصير، قررت المحكمة انها تفصلهم بسبب نوع، حجم، وطبيعة الجرائم الي متهم كل واحد منهم فيها.

بعد أقل من سنه على بدء المحاكمة، تحديدا بيوم 24 شباط 2021، أُغلقت قضية المتهم إياد الغريب: وتمت ادانته بالمساعدة والتحريض على ما لا يقل عن 30 من جرائم ضد الإنسانية وانحكم عليه بالسجن لمدة أربع سنين ونص.

وبعد 11 شهر من هداك التاريخ: تحديدا يوم 13 كانون الثاني 2022، أُغلقت قضية المتهم أنور رسلان: وتمت إدانته بالمشاركة بارتكاب العديد من الجرائم ضد الإنسانية بتشملها 27 جريمة قتل وقضايا عنف جنسي؛ وبالنتيجة، انحكم عليه بالسجن مدى الحياة.

وبهيك، وبعد مرور 11 سنه على بدء الثورة السورية بوقتها، كانت هاي المرة الأولى يلي بتّم فيها ادانة مسؤول سابق صاحب رتبه عالية بحكومة الأسد.

سليم: متل ما ذكرت بالبداية، قمنا بإنتاج سلسة بودكاست كاملة باسم: "الفرع 251"، والي تابعنا من خلالها محاكمة كوبلنز وغطيناها اول بأول… البودكاست تم نشره باللغتين العربية والانجليزية، بس النسخة العربية منه تحديدا كانت مهمّة لانها سدّت بشكل من الاشكال الفجوة الي تركتها محكمة كوبلنز بعدم توفيرها لترجمة عربية لاحداث ومجريات المحاكمة، الاشي الي تم انتقاده بشكل كبير وقتها.

طبعا ما كنا احنا الوحيدين المدركين لهاي الفجوة، مؤسسات حقوقية عديدة حاولت انها تغطي هاد الفراغ باشكال مختلفة، وعلى رأسها المركز الأوروبي للحقوق الدستورية وحقوق الإنسان، والي همه طرف منتج لهالكتاب الي عم نحكي عنه بحلقتنا…

ما رح احرقلكم التفاصيل، بالاخص انّا رح نغوص فيها مع طرفين الإنتاج والنشر، بس رح احكي انه اهمية الكتاب بالنسبة النا بتكمن بإنه ضمّ مؤلفين ومؤلفات من خلفيات مهنية منوعة، بالاضافة لتجاربهم وصلتهم الخاصة والمختلفة مع محاكمة الخطيب بكوبلنز.

سليم: شكرًا على انضمامك إلنا باتريك…

في بداية حديثنا بحب اعرف منك عن قراركم بالمشاركة لإنتاج هالكتاب.. شو الاشي المختلف الي بقدمه بعد كل اشي انكتب وانحكى وانتشر عن هالمحاكمة؟

باتريك (صوت مدبلج): هاي المحاكمة كانت المرة الاولى اللي بينحكى فيها عن التعذيب في سجون سوريا. وخلال السنين اللي كنا بنشتغل فيهم على بحث وترميز الجرائم هناك، (الاشي يلي بنشتغل عليه من منطلق قانوني بحت)، لاحظنا اهمية هاي الابحاث، وكيف انو مستحيل انه يتم العمل عليهم بشكل فردي، لانه النتائج بتكون كتير محدودة لما نعتمد فقط على القانون (بمعنى استخدام لغة القانون فقط).

ولهيك هاي الابحاث بتعيش لأنها موثقة وممكن تفعيلها بنطاقات مختلفة. في العلوم والفن والمناهج المدرسية وغعيرها.

من خلال هاي الطريقة ممكن نعمل فرق بيتعدى نطاق المحكمة. ولدعم هاي الابحاث، فكرنا انه انو مهم اننا نشارك بنشر كتاب بيتضمن عدة وجهات نظر عن هاي العملية. ويكون بيمثل كل هالموضوع في تاريخ سوريا.

كتاب بيتضمن شهادات من فنانين سوريين مثلا، بيقدروا يصنفوا هاي العملية البحثية ويدفشوها لقدام. وهيك بيصير في استمرارية لتأثير البحث بعيداً عن تأثيره القانوني فقط.

سليم: طبعا انتوا اشتغلتوا مع الوكالة الفيدرالية للتربية المدنية لانتاج هالكتاب، احكيلي عن هاد التعاون… هل كان عندكم اي شروط او تمنيات قبل ما بلشتوا، شو الاشياء الي اتفقتوا عليها مبسقا؟

باتريك (صوت مدبلج): احنا بالاساس كان في تعاون سابق بينا وبين الوكالة الفيدرالية للتربية المدنية، لهيك كان عندنا توقعات بتطابق تجربتنا السابقة، ولما حكينا معهم بخصوص هاد المشروع، وطلبنا انه يتم عمل نسخه عربية منه على طول وافقوا، وكمان لاحقا لما طلبنا نعمل نسخة انجليزية منه، ايضا ما ترردوا…

السبب ورا طلبنا انه نعمل نسخة بالعربي ونسخة بالانجليزي، مش بس نسخة المانية، هو هدفنا بِ إنّا نعمل تأثير بترك اثر على القانون الجنائي وعلى العلمية البحثية نفسها. وهالاشي ممكن تحقيقه فقط من خلال الناس المتأثرين بالموضوع. تحديداً السوريين، يلي بالنتيجة رح يستفيدوا من هالابحاث. لهيك ضروري انهم يقدروا يقرأوا الكتاب بلغتهم.

وفعلاً، قبلت الوكالة الفيدرالية متل ما ذكرت، وبالنتيجة زادت استعداديتنا للشغل لما لاحظنا اعترافهم بخصوصيته. واتشجعنا نعطي طاقة اكبر رداُ على ثقتهم فينا. وبنشكرهم على هالاشي.

سليم: احكيلي اكتر عن اختيار المؤلفين والمؤلفات، كيف تمت العملية، وشو كانت النتيجة؟

باتريك (صوت مدبلج): كنا بنحاول نجمع وجهات نظر مختلفة عن البحث. وطبعا النظام القانوني كان مهم والسياق بالقانون المدني الألماني. ف ركزنا على هاد الجانب. وهيك قدرنا نعمل مساحة للي الهم علاقة بالقضية ليكون الهم كلمة بالطرح.

اشتغلنا على اننا نوصل الخبر للسوريين اللي ممكن يعملوا تصنيف ومعالجة للقضية. سواءاً كان من الناحية التاريخية او الفلسفية او الفنية. ومن خلال اتباع هاي الاستراتيجية قررنا نتواصل بالدرجة الاولى مع اشخاص من شبكتنا. جزء كبير منهم وافق، وتم الانضمام، وبدأ الانتاج.

بالحقيقة احنا ممتنين اننا قدرنا نجذب ونتفاعل مع هالكتّاب والكاتبات… 

سليم: مهتم اعرف كيف الناس تلقوا الكتاب، احكيلي شو طبيعة ردات الفعل الي وصلتكم، بالاخص هلا بعد سنه من النشر؟

باتريك (صوت مدبلج): اه، وصلنا كتير ردود فعل ايجابية خلال السنة الماضية. وصار واضح كيف هاد النوع من الطرح الو تأثير دائم؛ لأنه ممكن الاستفادة منه بأي وقت. الحلو انه الوكالة الفيدرالية للتربية المدنية وفرت تنزيل مجاني للكتاب بالثلاث لغات، وهاد اشي كتير ممتاز.

الصراحة عم يوصلنا ردود فعل ايجابية عن الكتاب من الناطقين باللغات الثلاثة اللي تم ترجمته الهم، وواقعيا، نادر انو ينعكس متل هاد الإجراء الجنائي ضمن هيك نطاق مرة تانية. وهالاشي ورجانا ثمار جهودنا، متل ما بنقول.

الاشي الاهم بالنسبة النا هو انو قدرنا نحتفل ب كتاب ضخم هون ببرلين السنة الماضية. حفل اطلاق جمع ناس من بلدان مختلفة وناس من نفس المجتمع…

بتخيل بطبيعة شغلنا وصعوبته باوقات معينة (لأننا دايماً بنحاول نكسر حواجز مختلفة)؛ كتير مهم انو نخلق وقت بالنص، حتى لو وقت قصير، نشوف من خلاله انجازاتنا، ونقدرها، ونوثقها. وقدرنا نعمل هيك مع الكتاب والكاتبات…  

سليم: رائع.. يعطيكم العافية باتريك.

عندي سؤال اخير الك عن ما يتم تحقيقه بالمحاكمات ضد التعذيب الي بتمارسه الدولة السورية في سوريا.. وهون بقصد المحاكمات الي بتم باوروبا مثلا… بالنسبة الك، شو هو اثر استمرار المطالبة بالعدالة والمساءلة في خضم كل الظروف الي بتحيطها واحيانا بتعيقها؟ 

باتريك (صوت مدبلج): المحاكمة في كوبلنز كانت فريدة ومهمة من عدة جوانب. اولاً لأنها كانت اول مرة في العالم اللي بيتم فيها ادانة النظام السوري بارتكاب جرائم ضد الانسانية، من تعذيب وعنف جنسي.

هالاشي الو نوعية مختلفة عن التقارير، واللي هي مهمة جدًا كمان، من لجان الأمم المتحدة، من منظمات حقوق الإنسان، ومن نشطاء كتير شجاعين. لما تتم مراجعتها قانونيًا، ويكون في ادانة بيهتم فيها فريق دفاع بدقة على مدار سنين. ف مثلاً بيحرصوا على صحة الأدلة الي بيتم النظر فيها، ومن هالامور. وهالاشي الو سلطة مختلفة تماماً.

كون هالتجربة كانت الاولى من نوعها، بقدر اقول انّنا واجهنا جدار كبير من الظلم. ومن خلال كوبلنز، شفنا انه في شرخ عميق بطريق العدالة، وقديش الاشياء بتاخد وقت، بس مع هيك كان في حركة، ومحاولات مستمرة بالتغيير، هالحركة عملت تأثير فعلي بيثبت للضحايا قيمة صراعهم للعدالة. حتى لو هالعمليات بتاخد وقت طويل واوقات بيكون فيها كتير من الانتقائية، بس بالنتيجة وصلنا لمكان، في عندنا حالياً اول ادانة في باريس ضد مرتكبي جرائم من جهاز المخابرات السورية. بالإضافة لمذكرة اعتقال بشار الأسد.

هالإشي بنعتبره انجاز مهم انبنا بوقت الى حد ما قصير.

Branch 251 is looking for a Syrian co-host

Branch 251 is a bi-weekly podcast, covering the world’s first criminal trial dealing with atrocity crimes committed by Syrian officials: the Al-Khatib Trial in Koblenz, Germany. It features portraits of the main protagonists, commentary, analysis, and testimony from the courtroom as well as essential background information to explain the context of the trial. Branch 251 is especially committed to amplifying the voices of victims and their families looking for justice, and to contributing to essential outreach to affected communities. We are currently looking for a Syrian content contributor and co-host for our second season. Someone who is passionate about justice for Syria, who loves telling stories and who likes to work together creatively in a team.

If you would like to 

· Co-host episodes,

· Contribute to script, content and structure,

· Offer feedback and perspective to script, content and structure,

· Pitch stories,

· Possibly help develop, produce and co-host Arabic content, and

· Participate in weekly team meetings and brainstorms.

· A team player who likes to give and receive honest and creative feedback,

· Passionate about podcasts,

· A compelling voice, literally and figuratively, in English and in Arabic,

The Koblenz court recently rejected two motions regarding translation and audio recording of the trial. While the court argues these decisions protect witness testimonies and the road to justice, NGOs and legal scholars worry that denying translation and recording could diminish the impact of the trial.

‘Caesar’ is the code name of a Syrian military photographer turned defector. He was tasked with taking photos of dead detainees. Tens of thousands of them. How did the Branch 251 trial actually come about? 

Your hosts Karam and Fritz talked to someone who played an important role in transforming the terrible stories of these crimes into legal cases: Anwar Al Bunni. He has been instrumental in building the case and kick-starting this first criminal trial against Syrian officials. 

He was also imprisoned himself simply because he was doing his job as a human rights lawyer defending political prisoners in Syria. Eight years ago, he was detained in Branch 251 and was face to face with the main accused Anwar R. who slapped him in the face. But then, he saw him again, years later. In a refugee center in Berlin. And now, once more, in a court of law.
