Rudy Giuliani has failed in court yet again - this time in spectacular fashion. Giuliani had filed a lawsuit claiming President Joe Biden had defamed him in a 2020 presidential debate. Yet, after Biden's lawyer objected to Rudy's failure to prove personal jurisdiction to bring the lawsuit, Rudy "failed to object to the motion." The federal judge went on to rule that "Giuliani has utterly failed to carry this burden," and dismissed the case. Donald Trump is being prosecuted for (among other things) lying to his supporters about stolen votes and rigged elections. He whipped them up into a frenzy and then he told them to go to the US Capitol and stop the certification of a presidential election. Put another way, Trump intentionally lies to incite violence. It seems there's hardly a court case Donald Trump can't lose. The highest appeals court in New York has rejected Trump's attempt to get the existing gag order in his New York criminal case lifted. The appeals court rejected Trump's arguments and left the gag order in place while Trump's case is pending sentencing. Trump is circling the drain. The more JD Vance talks, the clearer it becomes that he's one of history's worst VP candidates. Not only does he mock, and alienate almost every conceivable voter group and demographic, but he just announced (in substance) that he would have helped Trump steal the 2020 election by supporting the fake elector scheme. Of course, the fake electors are being prosecuted in states around the country, as are the architects of the fake elector conspiracy. Undeterred, Vance seems to indicate that he would happily join those being prosecuted as one of their fellow co-defendants by joining the conspiracy to defraud the US, the conspiracy against voting rights, and by violating the Electoral Count Act. As The Washington Post reported, "Trump pledges to jail opponents, baselessly suggests election will be stolen from him." In advance of the upcoming election, Donald Trump is again telling the big lie about voter fraud and stolen elections and again inspiring people to anger and priming the pump for violence. Trump has demonstrated a track record for inspiring and inciting violence using his transparent election lies. Judge Tanya Chutkan ordered that Jack Smith file a brief on September 26th disclosing all of Donald Trump's acts on and around January 6th so she can litigate which of Trump's crimes and acts might be official presidential acts and which are not. Special Counsel Jack Smith and Donald Trump's criminal defense attorneys have filed a joint scheduling proposal with Judge Tanya Chutkan regarding their respective suggestions on how to litigate the absolute immunity issue in the aftermath of the Supreme Court's ruling that a president's official acts might be immune from prosecution. In the wake of the horrific Supreme Court opinion granting presidents immunity for committing democracy-busting crimes against the American people, Jack Smith decided to seize the initiative. Special Counsel Jack Smith has filed his appeal of Judge Aileen Cannon's dismissal of Donald Trump's classified documents/obstruction of justice/espionage case, urging the 11th Circuit Court of Appeals to reverse her lawless ruling. Because Judge Cannon has been found to have abused her discretion and reversed twice previously, many were expecting Smith to FINALLY ask the appeals court to remove her from presiding over Trump's case. Special Counsel Jack Smith has filed an appeal with the 11th Circuit Court of Appeals, urging them to REVERSE Judge Aileen Cannon's dismissal of Trump's classified documents/obstruction of justice/espionage case. The contrast could not be clearer or more consequential. Vice President Kamala Harris has spent her entire career working for the people. As we all know, Judge Aileen Cannon - who was appointed to the federal bench by Donald Trump - ruled that Special Counsel appointments are not lawful and she dismissed Trump's federal classified documents/obstruction of justice/espionage case. In a surprising plot twist, Hunter Biden's lawyers pointed to Judge Cannon's decision and tried to use it to convince another federal judge - Judge Mark Scarsi (who was also appointed by Trump) to dismiss the federal tax case pending against Hunter Biden. Judge Scarsi has rejected Judge Cannon's ruling and has refused to dismiss Hunter's case, clearly signaling that he thinks Judge Cannon is dead wrong. This is no surprise as every other federal judge who has decided the special counsel issue over the years has affirmed the lawfulness of special counsel appointments, thereby disagreeing with Cannon. Trump-appointed judge Aileen Cannon continues to wear her Trump favoritism on her sleeve. A number of motions filed by Jack Smith have languished, remaining unresolved for months. As but one example, back in May, Smith filed a motion asking Judge Cannon to modify Trump's conditions of release to stop him from lying about and endangering FBI agents. Cannon has sat on that motion. However, Trump filed a motion asking Cannon to stay or pause a number of deadlines in his Florida case while he briefs-up issues regarding presidential immunity. Judge Cannon acted on Trump's motion IN LESS THAN 24 HOURS, ruling in his favor and giving him precisely what he wants. As has long been the case, Cannon's "impartiality might reasonably be questioned," which is the federal legal standard requiring her disqualification from the case. But, of course, she will ignore the federal law and continue to preside over the prosecution of the very defendant who gave her her lifetime appointment to the federal bench. The Supreme Court didn't JUST rule that presidents have absolute presidential immunity. They actually ruled that presidents have absolute presidential immunity PLUS. Constitutional scholars left, right, and center are excoriating the new Supreme Court opinion that 1. contradicts the expressed language of our constitution, 2. actually repeals portions of our constitution, and, in essence, 3. declares the constitution is unconstitutional. Yes, that is illogical, but that is precisely what Chief Justice Roberts and the radical right-wing block of justices did in Trump vs. United States. This ruling gives Donald Trump a blueprint to convert America into a banana republic. And Donald Trump is exactly the kind of day-one-dictator who will do it. This ruling not only excuses lawless conduct by a corrupt president, it endorses such conduct, and thereby encourages future presidents to act lawlessly and to direct others to to the same then simply exercise his core constitutional power of the presidential pardon to pardon all of his criminal associates who carry out his unlawful commands. We have nearly 300,000 unsolved murders in the United States. That's 300,000 families who sit by the phone waiting for a call to come from a detective saying, "we've got a break in your loved one's case." These calls almost never come. When I retired from the Department of Justice, after decades of prosecuting murder cases in Washington, DC, I was determined to do something about that, and I proposed the Homicide Victim's Families Rights Act ("HVFRA") to Congressman Eric Swalwell, himself a former prosecutor. He heard me out and led the charge in an effort to bring long-overdue hope and help to homicide families. In 2022, the HVFRA became law, and it provides that homicide families have a legal right to require the involved police department to review the homicide investigation of their loved one and, depending on the results of the review, a full reinvestigation by a new team of detectives. We are now in the process of pushing this federal law to the states as model legislation to help homicide families in all 50 states. And we need your help - homicide families need your help. After more than 15 hours on the witness stand, Michael Cohen's testimony concluded. Although the defense attorney scored a couple points, Michael Cohen's testimony was consistent, corroborated and credible. On January 6th, 2021, Trump incited an insurrection, and as a result, he is pending federal prosecution for his attempt to overturn the results of the 2020 presidential election. One of Donald Trump's right-hand men, Steve Bannon, was convicted of two counts of criminal contempt of Congress, and was sentenced to four months in prison. In a remarkable move, Trump-appointed judge Aileen Cannon vacated (cancelled) the May 20th trial date in Donald Trump's classified documents/obstruction of justice/espionage case in Florida and she announced that she'll be setting no trial date for the time being. This is particularly outrageous given that Trump's own lawyers had previously suggested an August trial date. Judge Cannon's conduct is reminiscent of some of the evidence in Trump's New York case: David Pecker, head of the National Enquirer tabloid magazine, was involved in a crooked scheme with Trump to catch and kill damaging stories about Trump to help him in the 2016 election. Now, it sure looks like Judge Cannon is catching and killing Trump's Florida case, which undoubtedly will help him in the 2024 presidential election. Regarding Judge Cannon's pro-Trump bias, the recusal cup runneth over. Judge Juan Merchan, the New York State court judge presiding over Donald Trump's criminal trial for interfering in the 2016 presidential election, found Trump guilty of a 10th count of criminal contempt of court for violating his gag order again. It's not often that a presiding judge publicly calls out a defendant for lying outside the courtroom. Yet, that is precisely what New York State court judge Juan Merchan found himself having to do when Donald Trump claimed that a gag order prohibited him from testifying in his own defense at trial. As reported by The Hill, the "Judge in Trump's hush money (election interference) case clarifies gag order doesn't prevent ex-president from testifying."
