section 97-45-9. Offense against intellectual property; penalties There’s some big money fines for in appropriate actions.
One thing that I love about Mississippi is our music history. So many artists and such rich history are a part of our story. Tue, 20 Feb 2024 - 44min - 358 - In Legal Terms - Classic: DUI
Original Air Date: 9-12-2023
Each of our participants have been affected by a death caused by a drunk driver. We want to discourage you from drinking and driving. If you are stopped under suspicion of DUI you do have rights. Our guest attorney Francis Springer is going to tell us what those rights are. https://www.springerlawoffice.com/
If you’d like some extra information about Driving Under the Influence, check out the Mississippi Bar website and their page about driving under the influence. Like did you know if a driver is under 21, they are defined as intoxicated if their blood alcohol concentration level of 0.02?
https://www.msbar.org/for-the-public/consumer-information/driving-under-the-influence/
A person who is over 21 and gets a DUI, if there’s anyone under 16 in the car, the driver is guilty of Child Endangerment also. I hope this hits home to anyone who considers driving after drinking. We’ve talked about what could happen if you’re charged after a first offense of DUI but did you know: states talk to each other. If you get a DUI in another state, Mississippi still knows about it. So don’t have a first offense then you won’t have a second.https://law.justia.com/codes/mississippi/2015/title-63/chapter-11/section-63-11-30

On Thursday, February 8, the United States Supreme Court will hear oral arguments in the case of Trump vs. Anderson. Former President Trump and his attorneys are challenging a Colorado Supreme Court ruling that prevents his name from appearing on the ballot in that state.
The arguments themselves are expected to be one-hour in length. Attorneys for each side receive 30 minutes to make their case and answer questions from the Justices. We do not how exactly how long the Special Coverage will last - it depends on the precise start and end time of the court session itself, followed by analysis.

Tue, 30 Jan 2024 - 47min - 355 - In Legal Terms: Property Distribution
Laws are not the same from place to place in America. What might be legal in Louisiana or California isn’t necessarily the law here in Mississippi. Let’s learn about some of those differences today with our guest Professor Cal Peeler a guest professor at Ole Miss Law School. https://law.olemiss.edu/faculty-directory/calvin-peeler/
What courts handle the distribution of property in a divorce?
Chancery Courts have jurisdiction over disputes in matters involving equity; domestic matters including adoptions, custody disputes and divorces; guardianships; sanity hearings; wills; and challenges to constitutionality of state laws. Land records are filed in Chancery Court.
We’ve talked about domestic law a few times here on In Legal Terms. Most recently August 22nd of 2023 our guest was Chancery Court Judge Troy Odum and Child Support

Tue, 07 Nov 2023 - 44min - 346 - In Legal Terms: Ghostly Legal Stories
What a special show we’ve got today! As it’s Halloween, we’ll discuss some law cases with ghosts and spirits.
One Voice, the Mississippi NAACP, and other voter rights organizations crunched the numbers and found in Lowndes, Oktibbeha, Hinds, Franklin, and Jasper counties, over 50,000 people were purged from their lists of registered voters. Were they ghosts?!!!!?
“A bill that was passed last year encouraged circuit clerks and election commissioners to engage in more purging than they have usually been doing. And so that process may have led to some mistakes.” To see if you’re still thought to be in the land of the living and voting for next Tuesday’s elections – Anyone who goes to the Secretary of State’s Y’all Vote website can check their own voter registration. https://sos.ms.gov/yall-vote
Don’t get “tricked” when you go to the polls next Tuesday, November 7th 2023. Mississippians can go to the Secretary of State’s Y’all Vote website and get a sample ballot that just for their own precinct.
Mama always said “don’t take candy from strangers” and “don’t get into a car with a stranger” but if you need a ride to the polls next Tuesday, November 7th 2023 the MS Secretary of State’s office can hook you up with a legitimate ride.
Just call their FREE Voter ID hotline at 1-844-MSVOTER (1-844-678-6837) and tell them where you live. You’ll get the names of local transportation providers to contact to make travel arrangements to fit your needs. A transportation provider will pick you up, take you to the Circuit Clerk's Office and bring you home. There is NO charge to you for the ride. It is EASY and FREE. That FREE Voter ID hotline is 1-844-MSVOTER

A person who is over 21 and gets a DUI, if there’s anyone under 16 in the car, the driver is guilty of Child Endangerment also. I hope this hits home to anyone who considers driving after drinking. We’ve talked about what could happen if you’re charged after a first offense of DUI but did you know: states talk to each other. If you get a DUI in another state, Mississippi still knows about it. Tue, 12 Sep 2023 - 44min - 338 - In Legal Terms: Contracts 2023
You sign contracts every day. Do you read them? Do you have to read them? What makes a contract. Learn with us from Professor Martin Edwards from the University of MS School of Law. https://law.olemiss.edu/faculty-directory/martin-edwards/
The Band Van Halen notoriously had a clause in their contract forbidding brown M&M’s.
Insurance policies are contracts, but most of us rarely read them. What’s hidden in the fine print? https://www.independent.co.uk/news/world/americas/contest-fine-print-contract-win-georgia-donelan-andrews-a8814311.html
We may think that contracts are a recent thing – but history scholars are Contract History Scholars Are Aware of a 4,300-Year-Old Written Purchase/Sale Agreement from 2300 BCE. So if you think you don’t need a written contract – folks have known for a while now that written contracts are useful.

If you’re a contracts fan AND a movie buff, you’ll want to watch these movies with contacts at the heart of their plot: Shrek Forever After, The Hobbit: An Unexpected Journey, Disney The Little Mermaid, and Willy Wonda and the Chocolate Factory.

Samuel L. Jackson - he has a clause that allows him to golf twice a week during movie shoots.
Queen Latifah has included an anti-death clause in all her contracts; her quote: “If I die, I can’t be in the sequel,” she explained earlier this year.
Julianna Margulies wouldn’t agree to star in The Good Wife drama unless her contract stated that she was allowed to wear a wig.

Have you thought about getting a divorce? We’ll learn what you need to know and how the process works in Mississippi with guest attorney, Francis Springer. https://www.springerlawoffice.com/
Baby boomer divorce rates have risen dramatically over the last 30 years. So-called gray divorce rates, amongst adults aged 50+, the national divorce rate has roughly doubled since 1990. For those aged 65+, it has actually tripled, from 2 in 1,000 married persons to 6 in 1,000. This indicates people over 50 are more likely to get divorced now than ever before.Did you know: America has the third-highest divorce rate in the world. We’re after the Maldives and Belarus.https://legaljobs.io/blog/divorce-rate-in-america/

Welcome to 2023. We know we have both lawyers and people who might be clients one day who listen to our show. We hope in 2023, you’ll be the best you can be. We learn from our guest Mississippi Bar General Council Adam Kilgore “what makes a good lawyer” and “what makes a good client”.
The website: https://www.msbar.org/ is a wealth of information. There’s a video explaining jury duty, there’s a sheet that explains the court system in Mississippi. I like the legal terms and procedures page. (I found out the ms bar and the NCAA have different definitions of “holding”.) Don’t forget, if you need to hire a lawyer there’s a page dedicated to how to choose an attorney.
For the public, there so much information right on the front page of the Mississippi Bar website. There’s a handout for consequences of DUI – that should be mandatory reading in high school – There’s a tab called “Law as a Career” and information about the Consumer Assistance Program which helps people with questions or problems with Mississippi attorneys.
My favorite part of The Mississippi Bar website: the Pro Bono Resources. If you qualify, there are lists of organizations that help individuals that can’t afford legal representation. From the north to the south and in between, you or a person you’d like to assist might find a clinic that could assist.

Tue, 03 Jan 2023 - 49min - 303 - In Legal Terms: Educational Rights Encore
ENCORE FROM 01/25/2022
What are some of the laws surrounding teaching? How does our state teach how our citizens obtained their legal rights? Is Critical Race Theory new?
Our guest is Chauncey Spears, Education Policy Analyst from the Mississippi Center for Justice. https://mscenterforjustice.org/
https://mscenterforjustice.org/academic-freedom/
The Center supports every student’s right to a good education. This support includes fighting unjust attempts at whitewashing the history of racism in Mississippi and curbing the academic freedom of teachers and professors in our public school and university classrooms. MCJ supports the full and honest teaching of history and other academic subjects so as to help students understand the past and present contexts of their lives. Learning full and honest history and protecting the free exchange of ideas in classrooms are essential to racial reckoning and must take place in Mississippi to keep the state progressing toward a better future for all citizens. MCJ works with other advocacy groups and educators to protect the sacred space and trust educators must have in cultivating the minds of students here in Mississippi.

Tue, 26 Jul 2022 - 50min - 280 - In Legal Terms: Income Taxes
Winter, Spring, Summer, Fall are all lovely seasons but fleeting. It’s always tax season though. Whether you need to finish up from last year, get the jump on this year, or just learn some new information, it’s always time for a tax show with our favorite tax guru Professor Richard Gershon of the University Of Mississippi School Of Law.
If you’ve had other folks prepare your tax returns for you, the IRS has gotten much more “user friendly” https://www.irs.gov/ has a “file your taxes for free” spot with information and links to software you can use.
The IRS is hiring 470 revenue agents who will specialize in auditing or examining both individual and business taxpayers nationwide. These positions are at grades 5-12 in the federal civil service system with a base pay ranging from $31,083 to $68,299. Throughout July, the IRS is holding a series of virtual information sessions for interested applicants. https://www.irs.gov/newsroom/special-virtual-sessions-coming-up-for-those-interested-in-compliance-positions-irs-hiring-470-revenue-agents
