The acronym KPI (Key Performance Indicators) often strikes terror in the uninitiated lawyer. However, they are not only nothing to fear but a simple documentable measure you should embrace. KPIs are simply measurements of performance and they can measure anything you are doing; how many clients you close from leads, your collection rate, the number of cases you handle per month, etc. Once you understand you have all these measurable activities already available to you through the tools you use in your practice today (like your case management software) and actually start using them, your practice will only become more efficient and be more profitable.  Put your fear aside, listen and learn. I spent six years in the Air Force as a Navigator-Bombardier in KC135 and B52 aircraft during the Vietnam era. From that, I learned how to manage my time in a very disciplined environment. After my period of enlistment was satisfied, I worked as the Regional Sales Representative for a Japanese company traveling over 5 states as a commissioned salesperson. Income was directly proportional to my ability to sell product; it was there that I learned marketing. After six years in sales, as the company was closing their direct sales operation in the U.S., I considered my career options at 38 years of age and decided to go to law school as it provided me with the greatest flexibility and long term earning potential. After graduating from law school, I worked in a two person criminal defense practice representing clients charged with felonies. After two years of criminal defense practice with substantial trial experience, I was hired as the Litigation Director for a clinical program at T. M. Cooley Law School. I have been employed at WMU Cooley Law School since 1996 as a full-time professor of law. I teach in a clinical program for third year students in Estate Planning and also teach students in a Directed Study which I created, called Solo By Design. I have been interested in supporting students in solo practice since I was appointed to the Chairmanship of the General Practice Solo Concentration in 1999. Since then, I have developed a systematic approach to help law students make the transition to solo practice. Isolation will literally kill you.  Yet many lawyers don’t even realize they are isolated. They also don’t realize there are many forms of isolation that are insidious and destructive. There is professional, personal and social isolation and you may not even understand you are isolated. Isolation is a mental health risk. Today we dig in to raise awareness in the legal community. Amazon transformed the retail industry by networking small businesses together.  It eventually replaced the individuality of each small business with it’s own ‘brand’, Amazon. Soon, small businesses were able to reduce their overhead further by cutting out their physical real estate, cutting employees and simply marketing and selling their goods through Amazon.  This on-demand online company is a ‘networked platform’ and meets the customer where they are.  Imagine a network for lawyers that has nothing to do with a commercially branded company, but through bar associations, or through certain law schools or an AmLaw 100 firm.  Imagine a network for solos in a given state or region. Encryption is now part of your professional duty to safeguard your clients’ data. Encryption is a very techno-scary word for many lawyers.  It’s intimidating, actually. But even if it is, it doesn’t mean you can bury your head in the sand, not if you are going to represent your clients responsibly.  Encryption is critical when communicating with your clients, opposing counsel and the courts.  To not encrypt when communicating  can not only lead to ethics violations and malpractice, but it can also be violating state law.  Today Jared and I discuss different scenarios where you can actually be offering up your clients’ confidential data on a silver platter to whomever might want to take it, but also the ways you can easily and affordably secure this data.  We also discuss how you can transmit data to your cloud vendors pre-encrypted. When Kathleen Paukert first contacted me to discuss her book The Fulfilled Lawyer, my initial thought was this was another perspective on work/life balance.  However, once we started to dig into her law firm’s business model I saw the future!  I saw the future for solo practitioners who want to work within a collective of independent lawyers but still function and present like a large law firm primarily for all the perks solo practitioners bemoan not having because they feel isolated.  As Kathleen got deeper into the discussion I found the hairs on the back of my neck go up.  Kathleen Paukert’s (Paukert & Troppman) model IS the future.  If you don’t believe me, believe the large law firms already in existence under the traditional model who are now turning to her to learn how to implement what she has done within their own firms.  And she did it because she wanted to continue enjoying practicing law.  Please listen to this guest lecture (which admittedly starts out a little slow) and then click on the link to see an overview of the business model (PDF). I had the pleasure of finally meeting Ernie Svenson (after years of ‘knowing’ him online) and today Ernie is going to talk about the virtues, professionally and financially, of going paperless and how he did it.  Frankly, anyone starting a practice today should be paperless from the start and everything done to grow the practice should be predicated on this principle.  You will also enjoy anecdotally (if not belly laugh) at the stories Ernie shares on how he outclassed large firm opponents – something more and more paperless practitioners are taking pride in.  But it’s not about pride, it’s about truly effective advocacy for the client. Oftentimes, when we discuss social media it is in the context of how every lawyer should be using it for marketing.  Not this time.  Today we have Omar Ha-Redeye (who also teaches a course at Solo Practice University) discussing social media in the context of the legal process.
